MEMORANDUM

Consequent upon recommendation of the Fifth State Pay Commission for introduction of ‘Child Care Leave’ in favour of female State Government Employees, the matter has been under consideration of the Government for some time past.

After careful consideration of the matter, the undersigned is directed by the order of the Governor to say that the Female Govt. Employees having minor children may be granted Child Care Leave (CCL) by an authority competent to grant leave, for a maximum period of two years (i.e. 730 days) during their entire service period for taking care of upto two children upto 18 years of their age whether for rearing or to look after any of their needs like examination, sickness etc. subject to the following conditions:

(i) During the period of such leave, the female employees shall be paid leave salary equal to the pay drawn immediately before proceeding on leave.

(ii) It may not be granted in more than 3 (three) spells in a calendar year.

(iii) It may not be granted for less than 15 days in a spell.

(iv) Child Care Leave shall not be debited against the leave account.

(v) It may be combined with leave of the kind due and admissible.

(vi) Child Care Leave should not ordinarily be granted during the probation period except in case of certain extreme situation where the leave sanctioning authority is fully satisfied about the need of Child Care Leave to the probationer. It may also be ensured that the period for which such leave is sanctioned during probation is minimal.

(vii) Other terms and conditions as applicable to sanctioning Earned Leave shall be applicable in the matter of sanctioning Child Care Leave.

(viii) An account for the purpose shall have to be maintained under proper attestation by the leave sanctioning authority.

2. This order shall take effects from 1st January, 2012.

3. Formal amendments in the relevant rules of the West Bengal Service Rules will be made in due course.

      The order is only applicable for Govt. employees. Whether this Govt. will take into consideration of all other female employees of Govt. Undertakings, State aided/unaided Institutions / Local Bodies / Panchayats etc. is not known.

    with due respect sir/madam,i am a primary teacher at salboni jungle mahal.my service period one year nine months running. i have a little son lives in kolkata aged eight years.he stays alone throughtout the day.everyday i start my journey at early morning and come back home at 10pm.should i get ccl?hope Respected& Hon`ble C.M. can understand my problem.thanking you

    If Admin is not knowing any thing about the CCL of teachers of govt.aided school then he should not publish it.I think this is dictator rule.Whatever the govt. is wanting ,doing and we are just a slave.But perhaps they forgot that after 4 years where they will go?ELECTION!This is most shameless thing that we are seeing.MA.MATI,MAnus only promises.Nothing is fullfilled.

    when the question of without pay against 28th feb matter came, the school teachers are considered to stand in the same row of govt. employees as they are getting salary and pension by the govt. so.. where shall we have to stand regarding ccl matter? is this called fair administration?

    why this differ ? I think child deserves their mothercare in any ocation..
    So it should be applicable for school teacher/undertaking/ also it should be applicable for private concern..

    News– Teachers have filed a case in the court and stay order for CCL of the govt employees also. Don’t know the authentication of the news. If any anybody s aware of the fact plese let us know.

    CCL was announced in line with recommendation of The Sixth State Pay Commission Report. All West Bengal Govt. aided school teachers also come within the ambit of The Sixth State Pay Commission recommendations and their Pay is determined accordingly. Therefore, it is natural that Govt. aided school teachers will be eligible for CCL. The WB Govt. should issue the appropriate Govt. Notification soonest because one 57 year old Govt. aided School Teacher with a sick 16 year old son is keenly waiting to avail this leave.She has exhausted all her leave.CCL is very much needed by her. There may be other mothers in similar circumstances. Will the Honourable Chief Minister kindly approve and grant CCL
    to WB Govt. Aided School Teachers, please?

      It should be extended by govt. but spell should be minimum 90 days so that teachers in leave vacancy may be appointed by school … my personal feelings. and i don’t know whether Govt. will provide similar facility to teachers or not. (e.g. Child Adoption Leave).

      upto now no…why you can not write letter to CM, secondery eduction dept instead of writing here…also you can make a court case…..i have already done….if many people do this, govt will publish order for school teacher also….

      Could you please clarify if State Govt. Female Employees (Contractual) [ NOT GOVT. AIDED OR UNDERTAKING BUT DIRECT CONTRACTUAL GOVT. EMPLOYEES ] are eligible to apply for CCL?As i m not getting any response from this site regarding this fact , kindly let me know if you have any information.

    My wife is a direct Govt.employee under the Govt.of West Bengal.She applied for the child care leave
    for our daughter’s Exams.But the local Authority is refusing to sanction the leave giving reason that
    the ‘rule’ has not yet given clearance from the Finance Deptt. is it true?
    Is the local authority can refuse the application for the leave ?

    can a person proceed for the leave by just intimating to the authority and before getting the approval from the sanctioning authority?

    it appears that in ccl, sanctioning procedure of EL applies,but if the child becomes sick suddenly,how can an employee follow the procedure of EL by informing/applying for leave beforehand,getting approval and then proceed on CCL?further,if for the same ground,concerned authority denies to sanction the leave,what the employee should do?
