NOTIFICATION
Whereas, in pursuance of the provisions of sub-Section (2) of Section 69 of the Motor Vehicles Act, 1988 (59 of 1988), the State Transport Authority, West Bengal, issues/ renews the National Permits, in this State at present;
And Whereas, the process of issuance of National Permits have since been computerized and the issuance of National Permit Authorisations (in Form – 47) has now been made internet based, using the National Permit portal created for this very purpose by the Government of India, in order to make the process more user friendly and virtual;
And Whereas, the State Government has, for quite some time now, felt the need to decentralise the process of issuance of National Permits to the RTA levels, while considering that at present applicants come from far flung areas to the STA office at Kolkata for this purpose;
And Whereas, the Rule 89 of the West Bengal Motor Vehicles Rules, 1989 and the Notification numbers 9322-WT/3M-203/95 dated 06.11.1995 and 729-WT/3M-203/95 dated 13.01.1996 empowering the STA to issue/ renew National Permits have since been either omitted or withdrawn;
And Whereas, the Government has received legal opinion in favour of such decentralisation of the process of issuing of National Permits;
And Whereas, it is felt that such decentralisation will enable the motor vehicle owners to obtain all motor vehicles related services from a single office;
Now, therefore, in pursuance of the provisions of sub-Section (1) of Section 69 of the Motor Vehicles Act, 1988 (59 of 1988) and in supersession of all previous notifications and orders of Transport Department, that may have been issued in the past in respect of issue/ renew of National Permits, the Governor is hereby pleased to direct that henceforth the RTAs of this State will issue/ renew the National Permits to the motor vehicles registered in their respective regions.
This Notification will take effect on and from 02/09/2013.
