I am a Govt. Employee. Being situation bound I was compelled to take Earned Leave for 15 Days and submitted a prayer for E.L. ( not in proper format) to the office master. After returning from leave I submitted a joining letter to the office master, he endorsed it “H.C. please ask him to submit the leave prayer in proper format.” And I also submitted the E.L. prayer in proper format. But the E.L. prayer was not sent to the leave sanctioning authority by the office master. And within a few months I have got transferred to another district with promotion. The Service Book was forwarded to the new department with a comment ” Availed 15 days unauthorized Leave which is to be sanctioned. Now the questions are- 1.Can he write such comment even after the instruction to the H.C. on my joining letter? 2.What should I do to regularize the matter? 3. What will be the consequence of such comment? 4.Can I file a grievance against such office master and to whom? Please do help?-Biplab
We know that after EL is sanctioned, it is recorded in service book. Only after it is sanctioned. EOL is also one kind of Leave as per WBSR. It also needs a sanction. When such leave is not sanctioned then how can he write such statement, “Availed 15 days unauthorized Leave which is to be sanctioned”?
How did he know that such 15 days duration will surely be EOL? It may be some other kind leave also.
By the way, what did you mention as a reason while applying for EL?
I have to take earned leave for about one month for my wife’s treatment. how many days before should I applied for leave?can I apply in a letter or in proper format(WB Form no.2395) should I pray.what should I show the reason for leave?can I go for leave prior it’s sanction? because from experience it is seen that no action has been taken (I mean for sanctioning the leave immediately) in favour of he incumbent before he/she is going to leave by the authority.can I apply for EL after absent from office for one or two days for urgent reason? should I give joining report for those? is there any right to not to sanction earned leave for above cases.
If you are a Group A employee, you should apply for EL as per WB Form No. 2395. Otherwise application in plain paper is OK.
Reason for availing EL may be Treatment of Wife; no problem.
AFAIK, You can go for EL without prior intimation but you should inform authority within 3 days.
Joining report is a must in case of EL.
Authority has every right not to sanction any kind of leave.
Remember “Leave is not a matter of right“. (WBSR-II)
many many thanks to nemo. now my question is if i go to leave(EL) after giving application to my higher authority for one month in any emergency like my wife’s treatment & after returning from leave if I could have known that it was treated as unauthorized absent or no action has been taken for sanctioning the leave after submitting joining report also, what will I do?
