Sir, I have joined a PSU after retirement from Air Force. The joining was based on written Exam followed by interview / merit list. The application for written exam/interview was forwarded after taking NOC from my previous service. In the new job, my salary is 15,000 less than my pervious service. Am I eligible for pay protection here? please help me out as it is a financial crinch to me.

In the first instance, it appears that you are not eligible for protection of your last pay.
However information in detail may help in judging the case in a proper way.September 16, 2013 at 7:54 am #78673AnonymousInactiveSir, The Post Of Hindi Translator in central Govt/ PSU carries A grade pay of 4200 & total salary is appx 40,000/- PM where as In the PSU cottainer Corporation of India , here is no grade pay , the total salary is appx 25,000/- . I can pt up my case with required information if some one can help me with rules on payprotection. thanks a lot.

Sorry, could not manage to reply timely. So what appears from your post that you served as a Hindi Translator in Air Force with a Grade Pay of Rs. 4200 and joined a PSU ‘Container Corporation of India Ltd.’ after retirement with a total pay of Rs. 25000/-.
Now you are silent about your pension amount. In case of military personnel re-employed in a Govt. Job in West Bengal, his pay is regulated by rule 55B of W.B.S.R. Part-I, reading with sub-rule (2) of rule 83 of W.B.S.(D.C.R.B.) Rules, 1971. But since ‘Container Corporation of India Ltd.’ is a Govt. of India enterprise, these rules will not be applicable to you.
Since you are receiving pension and the PSU have a pay structure of its own and you were appointed afresh through examination (as it appears from your post), it seems that you are not eligible for pay protection. By the way, pay protection does not cover the gross salary, it protects only the basic pay.
Others members, having expertise over Central Govt. Rules are requested to take up the matter to help Mr. Kumar

Pls give details of your pay drawn at the time of discharge from Air Force and, pay being drawn at present in PSU.

(a)&(b):As per the instructions issued by Department of Personnel & Training from time to time, no protection of the pay held by the Ex-Servicemen (ESM) prior to retirement is given and he is allowed to draw pay only in the prescribed pay scale / pay structure of the post in which he is re-employed.
(c)Instructions / guidelines in this regard are issued from time to time by the respective nodal administrative ministries and it is the responsibility of the respective organizations to implement the same. Matter of pay protection is contradictory in the light of the discussion in the Parliament which was referred to in the previous post.

Is this letter clear on pay protection. There is DOPT guide line No 1213/2009-pay-1 dated 30 Mar 2010 signed by Rita Mather (Director Pay).
