Order
Consequent upon incorporation of Section 357C, by way of amendment, in the Code of Criminal Procedure Code, 1973, all hospitals within the territory of the State of West Bengal either run by or registered with the Government of West Bengal shall provide first-aid or medical treatment, free of cost, to the victims of any offence covered under Section 326A (for voluntarily causing hurt by use of acid, etc.), Section 376 (for rape), Section 376A (for causing death or resulting in persistent vegetative state of victim), Section 376B (for sexual intercourse by husband upon his wife living separately under a decree of separation or otherwise without her consent), Section 376C (for sexual intercourse by a person in a position of authority or in fiduciary relationship or a public servant or a superintendent/ manager of a correctional home, remand home or other place of custody established by law or anybody being in the management of a hospital or being a staff of a hospital), Section 376D (for gang rape) or 376E (for repeating commission of offence under Sections 376, 376A or 376D) of the Indian Penal Code, 1860, and shall immediately inform the police of such incident.
This order will take immediate effect.
