ORDER
Whereas, in terms of provision of sub-rule (2) of rule 58 of the West Bengal Panchayat (Gram Panchayat Administration) Rules, 2004 read with section 47 of the West Bengal Panchayat Act, 1973 and subsequent amendments made in the aforesaid Rules, a Gram Panchayat may issue certificate of registration for running trade, wholesale or retail within its jurisdiction in Form 11 appended to the aforesaid Rules, unless such registration is prohibited under any law for the time being in force and it may be renewed for three years at a time:
And whereas, in terms of the provision of rule 57 to 63 of the West Bengal Panchayat (Panchayat Samiti Administration) Rules, 2008 read with section 116 of the West Bengal Panchayat Act, 1973 and subsequent amendments made in the aforesaid Rule, a Panchayat Samiti may issue certificate of registration for trades of special nature within its jurisdiction in Form 6B appended to the aforesaid Rules and it may be renewed for three years at a time;
Now, in exercise of the power conferred under section 212 of the West Bengal Panchayat Act, 1973, the Governor, alter careful consideration of the whole matter, is hereby pleased to order the following:
(1) Gram Panchayat shall henceforth issue certificate of registration for running trade, wholesale or retail within its jurisdiction, unless such registration is prohibited under any law for the time being in force, with the validity of three years at a time after realizing the requisite fees mentioned in rule 58 of the West Bengal Panchayat (Gram Panchayat Administration) Rules, 2004 read with subsequent amendment;
(2) Panchayat Samiti shall henceforth issue certificate of registration for trades of special nature within its jurisdiction with the validity of three years at a time after realizing the requisite fees mentioned in rule 63 of the West Bengal Panchayat (Panchayat Samiti Administration) Rules, 2008.
