Clarification regarding FD Memo No. 9008-F dated 16.09.2021

MEMORANDUM

It may be recalled that the Finance Department Memo. No. 9008-F(P) dated 16/09/2011 was issued to grant security of tenure, consolidated remuneration, annual enhancement, leave, terminal benefit, etc. to casual/ daily-rated/ contractual workers who were engaged prior to 01/04/2010 with certain terms and conditions. In subsequent orders of this department issued vide No. 4011-F(P) dated 20/05/2013, No. 1107-(P) dated 25/02/2016, No. 1033-F(P2) dated 08/02/2019 and No. 1091-F(P2) dated 01/03/2024, service conditions and remuneration structures of these categories of workers were further improved.

Now, references are being received from different comers regarding applicability of the above orders issued in continuation of No. 9008-F(P) dated 16/09/2011. In this regard, it is hereby clarified that:

1) After issue of No. 9008-F(P) dated 16/09/2011, the State Government has issued a few orders allowing fresh engagement of contractual personnel extending the benefits contained in No. 9008-F(P) dated 16/09/2011 and its subsequent orders. For such cases, as engagement period is less than 5 or 10 years, provision for accommodating such contractual personnel has been made in No. 4011-F(P) dated 20/05/2013, No. 1107-(P) dated 25/02/2016, No. 1033-F(P2) dated 08/02/2019 and No. 1091-F(P2) dated 01/03/2024.

2) Other than above, Finance Department has also allowed contractual engagement having different sets of terms and conditions and remuneration structure. Such contractual personnel will continue to be guided by such conditions as fixed by the Finance Department for them and not by Memo 9008-F(P) dated 16/09/2011 and the orders issued in continuation of it.

If further clarification in this regard is required, the same may be referred to Finance Department separately.
