I am directed to refer to this department’s letter No. 1378(125)-PL dated 21.03.2012 issued by the Addl. Chief Secretary, Home Department and subsequent letters No. 1905(125)-PL/PE-15S-396/10(Pt) dated 23.04.2012 and No. 4135(12S)-PL dated 25.07.2012 issued by the Joint Secretary, Home (Police ) Department and to send herewith a copy of the order dated 05.04.2012 passed by the Hon’ble High Court at Calcutta, on the subject noted above directing to issue circular that the National Emblem without ‘Satyameva Jayate’ should not be used by the department or that the said Emblem cannot be used at a place where the said office or the authority has no right to use the same.

2. The department has, time to time, issued circulars to take appropriate action to ensure proper use of the National Emblem by all concerned, in keeping with the provisions contained in State Emblem of India (Provisions of Improper Use) Act, 2005.

3. I am also directed to request you kindly to take appropriate action to ensure proper use of the National Emblem in compliance with the order dated 05.04.2012 of the Hon’ble High Court, Calcutta and also to keep a constant watch so that no violation is made by any person/ persons/ associations and others who are not entitled to use the same under the provisions of law.

4. Principal Secretary, Department of Transport may also kindly issue circular, in compliance to the concerned authorities under his control to ensure proper use of National Emblem in the cars in use.
