For the above mentioned posts, the gradation list is prepared according to the merit list of recruitment and 50 point reservation roster is followed.
Now, to avoid the recruitment procedure by the authority, they recruited from the old panel prepared earlier. As the date of joining in such example is more than 1 year, it should be validated by competent authority and clarify the procedures to be followed in case of promotion.

Dear Sir,
I am a Scheduled Caste Government (W.B.) employee (Assistant Engineer, Civil) posted at Howrah Improvement Trust and at 6th position of gradation list .There are six (6) resultant vacancies for promotion in the next higher post of Executive Engineer in my office since long time . I am serving in the post of Assistant Engineer for two years . In this situation , as a Scheduled Caste candidate will I be eligible for promotion in the post of Executive Engineer immediately ?

Being an S.C. candidate is not the sole criteria for the promotion. Let’s check first what are basic required criteria for promotion to higher posts –
A. Confirmation in the basic post – Normally it takes 3 (i.e. 2 years of temporary service +1 year of probation period if not otherwise prescribed in the Recruitment Rule).
B. Satisfactory Performance.
Now, let’s see when an S.C. candidate is eligible for promotion in observance of the Reservation Policy.
1. When there is a reserved vacancy or carried forward reserved vacancy for S.C./S.T.
2. When his Performance is ‘good’ or even ‘average’.
Now, please check whether your Recruitment Rules prescribe any specific period for probation. If not, you will get your turn after your confirmation in the post of Assistant Engineer i.e. on completion of 3 years of Service from the date of appointment. Since you have completed 2 years, you will have to wait 1 year more.
You forgot to mention whether there is any more S.C. or S.T. candidates in the Gradation List before you. I assume, NO. Since you have completed 2 years, you will have to wait 1 year more…….Whether it is only confirmation in service or confirmation followed by completion of RESIDENCY PERIOD of the post held by an employee. As I understand the candidate whether unreserved or reserved MUST complete the prescribed residency period for being included in the zone of consideration (if applicable). Completion of residency period is the first criterion, then comes the role of ACRs. There is no relaxation of residency period for reserved candidates. The period is SAME for all employees working in a particular post.

It was found from the gradation list that the ST candidate who had joined on 21/11/2005, is junior to the SC candidates who had joined the organization on or after April 2007(He got chance only after resignation of the candidates who joined on 21/11/05). For your kind information that in the merit list that SC candidates was before the ST candidate.Similar things happened to the SC candidates over General candidates.
Seniority in gradation list is determined on the basis of original merit list prepared by the UPSC/PSC at the time of initial selection if there is no delay in joining caused by the candidate. In present situation the wait listed SC candidate is originally more ‘meritorious’ than previously appointed ST candidate as per selection record. But, because of inadequacy of SC posts he was not appointed earlier. When he was appointed from wait list in the second phase from the SAME SELECT LIST (Merit List) prepared on the basis of same phase of selection he got his position above ST candidate in gradation list in accordance with his position in original select list. Delay of his appointment is attributed to the creation of vacancy due to relinquishment of few SC candidates who were earlier appointed in first phase from the same select list. Therefore, such delay is not caused by the candidate, and the original select list was revived by the deptt. in public interest to make room for wait listed candidates. So, in this particular case, the date of joining has no role in determining the inter se seniority – rank in the original select list is final.

Thanks, but could you please elaborate on RESIDENCY PERIOD and it’s link with ZONE OF CONSIDERATION, in respect to State Services?
So far my knowledge is concerned, Confirmation in the state services are done following the completion of 2 years of Temporary service + 1 year of PROBATION PERIOD (generally). On being confirmed, one employee becomes eligible for coming within the Zone of Consideration. No special Residency Period is to be completed. If there is something like RESIDENCY PERIOD beyond the 2 years of Temporary service + 1 year of PROBATION PERIOD (generally) to become eligible for Zone of Consideration, few of Our decisions are to be reviewed. In case of promotion of central govt. employees, there is a minimum qualifying period of service (Residency Period) for each post in addition to period of probation. For example: In Group-A service, GENERALLY 5 years for Entry Grade of Gr-A post (GP 5400), 5 yrs for post carrying GP 6600, 5 yrs for post carrying GP 7600 etc.
For post carrying GP 5400 in organised Gr-A service, the residency period is reduced to 4 yrs (and not 5 yrs).
In my present organisation, few SC officers (Gr-A) could not be promoted to the senior post carrying GP 6600 last year as they could not complete the residency period of 5 yrs in the feeder grade post carrying GP 5400. Their ACRs (now known as APAR) were not forwarded to DPC. Therefore, few SC vacancies in senior post remained unfilled.

Yes, I was talking about Central Govt. rules for promotion. I thought there are similar rules for state govt. employees also.
Anyway, according to the DP&AR OM No. AB.14017/5/83-Estt.(RR) dated 7.5.84:
PROBATION
3.10.1 Column 9 (Period of probation) In the case of Organized Services, the following standard provision may be
inserted in the Recruitment Rules.
PROBATION
1. Every officer on appointment to the Service, either by direct recruitment or by promotion in Junior Scale shall be on probation for a period of two years.
Provided that the Controlling Authority may extend the period of probation in accordance with the instructions issued by the Government from time to time.
Provided further that any decision for extension of a probation period shall be taken ordinarily within eight weeks after the expiry of the previous probationary period and communicated in writing to the concerned officer together with the reasons for so doing within the said period.
2. On completion of the period of probation or any extension thereof, officers shall, if considered fit for permanent appointment, be retained in their appointments on regular basis and be confirmed in the due course against the available substantive vacancies, as the case may be.
3. If, during the period of probation or any extension thereof, as the case may be Government is of the opinion that an officer is not fit for permanent appointment, Government may discharge or revert the officer to the post held by him prior to his appointment in the service, as the case may be.
4. During the period of probation, or any extension thereof, candidates may be required by Government to undergo such courses of training and instructions and to pass examinations, and tests (including examination in Hindi) as Government may deem fit, as a condition to satisfactory completion of the probation.
5. As regards other matters relating to probation, the members of the Service will be governed by the instructions issued by the Government in this regard from time to time.
According to the DOP&T OM No. 21011/2/80-Estt (C) dated 19.5.1983:
3.10.2 In the case of other posts, the period of probation, may be prescribed on the following lines:-S. QUALIFYING SERVICE FOR PROMOTION
3.12.2 The qualifying service for promotion from one grade to another is necessary so that there is no premature promotion or undue jump in pay and also to ensure that the officer has sufficient opportunity to demonstrate his competence/potential for holding the higher post. The period of qualifying service varies from post to post depending upon the scale of pay and the experience, required for manning the higher post. Broadly, the following qualifying service for promotion from one grade to another may be followed as a guide:

@ srounaks: As you are serving as an Assistant Engineer for 2 years only. You are not eligible for promotion at this moment. It is the service condition for Assistant Engineer’s that they must have to complete 6 years of satisfactory service and must have to pass all papers in departmental and professional examinations. This rule is applicable for Assistant Engineers of State Govt. PWD, PHE, I&WD. So, I hope this is also applicable for HIT also. -
