I joined in Govt service as Basic Grade Typist on 05.04.1994 and got CAS as eight years’ completion 02.02. 2002. After that I changed my service and joined as Schedule A Stenographer PA on 07.02.2005 in Finance Department without losing pay protection.Since I completed 16 years in the year 2010 from the date of joining my service and I claimed for CAS 16 years, but the Finance Department is disagreed to give me 16 years’ benefit in the year 2010. They are telling that my new appointment will be treated from the date of 07.02.2005 and my next CAS will be in the year 07.02.2013. Since the Finance Department is disagreeing my claim I am losing two year’s financial amount without any fault of me.
Kindly clarify.
Finance Dept. is correct in the application of provisions of CAS in your case. CAS was first introduced in year 1990 with retrospective effect from 01.04.1989 vide FD Memo No. 3075-F dated 21.06.1990. It provides financial benefits to various State Govt. employees on FIRST APPOINTMENT in a service where employees’ interest is protected by way of allowing financial upgradation to next higher scale on completion of prescribed period of regular service if the prospect in NORMAL CHANNEL OF PROMOTION is somehow defeated. The scheme was devised in such a manner that even if promotional avenue in the cadre in which an employee is borne is chocked due to nonavailability of vacancy, he should not be allowed to lose financial benefit which he would have got had he been promoted to next higher post in normal channel. But, in your case, you have changed the service and, is now DISTRACTED from the ‘normal channel of promotion’ of that cadre in the previous department. This is your SECOND APPOINTMENT in new service with entitlement to the past service benefits. Therefore the effect of first appointment in previous employment should not be counted for CAS benefits.
For the sake of argument, if we consider counting of your previous employment for CAS benefit, it will be seen that you have already moved to higher scale when you have been appointed to higher post in new service after 8 years and, thus you are financially upgraded in your career. So, no further CAS benefit can be allowed on completion of 16 yrs of service. But, this justification is not applicable as it is your second appointment which can not be clubbed with the first one for extension of CAS benefit!
One employee joined in service as HA(F) on Sep.2005. As she passed GNM course,hence she subsequently appointed as GNM & joined in this post on Mar-2009. As primarily she joined in service as HA(F) & again she joined as GNM; the H & FW deptt. order to count her qualifying service for pensionary benefits interns of rule 22 of WBSR(DCRB) rules,1971 from the date of joining as HA(F).
Now question is arise,will she get the 8 yrs MCAS benifit on Sept-13? if no, cause pl be stated. In this cotext it is stated that, in both cases she received the appointed letter joined accordingly.The reply can solve the problem.

Counting of years of Service under MCAS starts every time from zero if appointments are fresh appointments i.e. if the cadre of the service is changed. Here her service in the new post starts from March, 2009 and 8 years will be counted from that date.
Rules in this regard (G.O. No. 3015-F dated 13.03.2001) state –
A Government employee may be allowed to move to his respective next higher scale on completion of eight years of continuous and satisfactory service in his revised scale of the post and its corresponding unrevised scales taken together….
Counting of past services towards pensionary benefit, increment benefit, restoration of pay etc. are different concepts. The policy of MCAS is completely different in this matter.

I fully agree! MCAS is related to financial upgradation when the normal channel of promotion fails to benefit a deserving employee!
