I am facing difficulties on the following:-
An employee under the control of the Additional District Sub-Registrar [(Finance (Revenue) Department), Employer is the District Registrar, Uttar Dinajpur] claiming CAS benefit for 25 years after his retirement on superannuation on 30th April 2013.
Details in a nut shell is as follows:-
(1) The concerned employee was promoted to the post of Upper Division Clerk on 20.08.2002 in the scale of pay Rs. 4000-8850/- (pre-revised scale),
(2) His last scale of pay (prior to promotion to the post of UDC) was Rs. 3800-7775/- (pre-revised scale),
(3) He has drawn Band Pay Rs. 14580/- Grade Pay Rs. 3600/-, Total Rs. 30661/- (including DA, HRA & MA) in the last month of his service i.e. in April 2013.
This is to be mentioned here that the employee in question once refused a scope of promotion for the post of Head Clerk, i.e. he has for go the post “Head Clerk” might be it was 2005-2007.
Dear Members, please post your valuable comments and details on the following questions:-
(i) Whether the employee is eligible for 25 years CAS benefits at present?
(ii) If he is eligible, who is the authority to fix up his pay? Treasury or Additional District Sub-Registrar (controlling authority), or District Registrar (Employer), as the employee has already been retired!
(iii) If not Treasury, how can I fix up his pay or CAS benefits for 25 years?
I am awaiting for constructive suggestions from the beloved members of this forum!

You missed to provide the following details:
1. Date of entry into Govt. service.
2. Whether any previous CAS benefit i.e. 8/10/16 yrs CAS was awarded or not; if so on which date.

(1) Date of entry into service is : 25th April 1986 (Date of joining),
(2) Got 10 years CAS benefit on: 01st April 1996,
(3) Got 16 Years benefits on: 31st March 2002,
(4) Promoted to the post of U.D.C. on: 20th August 2002,
(5) Refused Promotion to the post of Head Clerk on: 19th November 2008 (duly entered in his Service Book).
Please suggest me, what can I do in favour of the candidate as there is none in my office to handled it. The candidate pressing me hard for the purpose. For the service matter I am depending on this forum and its learned members. I have attached herewith the old CAS rules of 1990 for ready reference.

Firstly, I am sorry for the above comment. It is quite possible to award benefits to a retired employee.
(2) Got 10 years CAS benefit on: 01st April 1996,
(3) Got 16 Years benefits on: 31st March 2002,Secondly, I like to inform you that, the above date of effect of 10 and 16 years CAS benefit is erroneous. It should be 25.04.1996 and 25.04.2002 respectively.
Lastly, It is noticed that the employee got 2 nos. of CAS benefit and one regular promotion. So, he is not further eligible for CAS benefit.
CAS is awarded only when an employee do not get regular promotion. Here in this example, the above employee was awarded 16 years CAS benefit in 2002; and after that a regular promotion. I agree with you, but those date are taken from his service book. After all, the suggestion is very very helpful for me. Huge thanks to you and hope your activeness on every queries will increase day by day. Thank you so much. Amazing! The employee in question is received entire retirement benefits!!! Anyway, your answers to be submitted for guideline before the District Registrar tomorrow.
