after cancellation of 438-SE by the order of vide memo no. 566-SE, there is no order that m.c must give permission to the teacher for their higher studies. can you post recent high court order on that matter-“no one can hamper a high school teacher to take higher education without hampering his normal duty”?August 28, 2015 at 11:15 am #81002AnonymousInactive@dip bhattacharya Till date there exists no such order. It might be a rumour. But, if you apply for for higher education through proper channel and promise that you won’t claim the higher scale of pay (in case of Hons. post) as School Expenditure Act-2005 hinders it, you are sure to get the said permission from the M.C. and the D.I.

look at my problem: i am an asst. teacher of math(H/PG) of pg scale. my degree is m.sc in applied mathematics but less than 55%. now i want to admit in Netaji Subhas Open University for study of M.sc in math with spl papers from pure mathematics.
my questions are:
1. can m.c give me any permission or no objection for that? is there any g.o or court order? plz post it.
2.my first m.sc from regular mode. is the any legal or other problem arise for the second one?
3.if above are yes then what can i do? m.c does not give me the permission as there is no order.

You are already posted in PG scale and doing Masters in any other subject is not a case of Enhancement of Qualification. So SMC or the DI/s will never give you permission for doing Masters in any other subject as in your case it is in no way relevant to your present post.
2. If you do Masters in any other subject in distance mode, i.e., by not hampering your regular duty, no legal complication will arise in future. So you can do it without the Permission of the SMC or DI/s.
3. But in future if you are selected and wish to join another post with your new degree, you may not claim continuation of service from your present post.

1. Do I require permission from the Authority?
2. Will the Degree be valid without permission?
3. May I have to submit my previous PG Degree?
4. May I use the Degree in future?

Do you to do PG course in English itself again? if both the answers are yes I think there is no scope because one cannot do same degree in same subject twice. However, please see other opinions from our friends for your remaining queries.
September 21, 2016 at 9:37 am #81937AnonymousInactiveI am pass graduate teacher,join my post on 26/09/2008,before my joining I completed my MA 1st year exm ,so in final year I took without pay for only exam date i.e from 5/3/2009 to 14/3/2009,and MC also gives permission but don’t take any permission from DI .So is there any problem to write this in service book,or regarding increment.
September 21, 2016 at 1:49 pm #81941AnonymousInactiveYou have joined as a Pass Graduate Teacher. So, you will not get Higher Scale. There is no relation regarding INCREMENT. It is depends on your B.Ed degree only. Your S/A may write neither in your Service Book nor in your Profile.
