    ………… If DI has any objection then he should tell me before giving the permission. ……………….. managing committee has sent the application 15 days later,how they can reject the same? What was my fault? …………………. DI has approved the same before my appearance in the exam. …………………………………………… If he had any problem he should not give the approval for examination. That’s my question.

    I am sending reproductions of two High Court verdicts for reference. Pls go through the court orders passed in the Writ Petitions, especially WP No. 6321 (Prosenjit Paul Case) which will help you a lot to understand the merit of your case. There is a glimpse of hope!

    ES/O/B/IM-98/2007
    In Para 8.- “Henceforth no permission will be accorded for securing higher qualification for obtaining higher scale of pay to any assistant teacher and/ to any assistant teacher over 50 years of age serving in any Junior High School or any school respectively”.
    So you will not get permission from the D.I. for your HIGHER STUDY. But you will study in your own interest without no study leave.
    Suppose you will do so. But when you will appear for SSC to join in a HIGH/HIGHER SECONDARY school then you will face with an another problem. Your M.Sc would not be granted, because you did it without permission of D.I.
    I do not know your age or year of experience. If there is much time, then there is a solution, you may appear as a fresher candidate. I want to say that you will not get your service continuation.

    It’s apparently clear that Amit Basak is below 50 yrs. It’s not clear whether he/she is in higher secondary school or not. The D.I. made objection b’coz the M.C. forwarded the representation to D.I. on 17.02.2000 i.e. 15 days after he took admission in MA course (01.02.2000). Since MC accorded permission, the course was completed with knowledge of D.I. , D.I. never objected to the pursuance of MA course and allowed him to take final exams, he is eligible for increment provided he was appointed as AT (Hons./PG). G.O. dated 27.11.2007 has no application in this case as he completed (!) the course before Aug.2005.

    I have joined as assistant teacher in a junior high school in h/pg category . I applied to my secretary (ad hoc committee) for allow me to continue my study (m.sc). But he reject my application and told me, since my post is in additional vacancy, I’m not allowed to continue my study for 2 years, I’ll get permission after confirmation of my job.is it true? please provide the documents.

    If I don’t take permission from m.c and apply d.i for the permission then? Can I get increment after completing my study?

    Ohh…im confused….i hv applied for m.sc in distant mode, but secretery refused… …….i hv some question..1) if i enrolled in msc(distant mode), is it necessery to take permission? 2)after completing my m.sc , am i eligible for increament? 3) is there any govt order regarding distant education

    Prior permission from the M.C. merely for carrying out higher study by in-service teachers is ESSENTIAL. If they want to claim financial benefits in the shape of double increments or higher Grade Pay after improvement of such qualifications, prior approval of D.I. is also ESSENTIAL vide G.O. 593SE dated 27.11.2007. If an in-service teacher enhances his qualification through regular/correspondence/distance mode of education WITHOUT permission of M.C. or D.I., as the case may be, he shall NOT be recommended by SSC for getting the advantage of such higher qualification in the subsequent appointment in any school with all the benefits of his past service. Pls refer to Rule -18 (b) of RLST rules for Asst. Teachers and H.M. recruitment as follows:
    “Rule – 18. Bar on recommendation.- Notwithstanding anything contained in these rules, a Regional Commission shall not recommend the name of a person under rule 17,-
    (a) ………………….
    (b) who, while in-service, having obtained required degree for being considered for the post applied for fails to submit before the Regional Commission the requisite document of his approved study leave, or any kind of leave for the purpose of relevant higher studies, or permission from the appropriate authority for prosecuting the studies for the said degree.”

    Educational degree may be obtained through regular course or correspondence course or Open & Distance mode of education. Pls see the link:

    On the other hand, there is a clear instruction in the G.O. No. 593-SE / ES/O/B/1M-98/2007 dated 27.11.2007 in relation to prior permission for enhancement of qualification of Asst. teachers appointed with Pass graduate degree through SSC that:
    “4. Provided further that no such permission can be granted on any ground to any teacher who has entered the service / joined the School with Graduate Degree and with a graduate scale of pay [Any Managing Committee of any School recommending such case and of any District Inspector of Schools granting such prayer will be treated as an ‘Offender’ under West Bengal Schools (Control of Expenditure) Act, 2005]”
    A plain reading of the above two provisions leads to the following point of doubt:
    If this be the situation then how a pass graduate AT working in an aided school on regular basis through one SSC selection can acquire Spl. Hons./P.G. degree and get appointment to Hons/PG post in another school through another SSC selection?
    If the pass graduate AT obtains Hons./PG degree without permission of M.C. and wishes to join Hons./PG post in any school in subsequent SSC selection, he/she has to SUPPRESS his/her past employment in the application form and appear at SSC exam. On selection, he/she shall join the new post WITHOUT benefit of past service. In such a situation he/she should lose the benefit of the pay fixation in new service. Moreover, this may lead to problems in getting some pensionary benefits where length of total service matters most.
    What is the prospect of a pass graduate teacher or a hons. graduate teacher appointed to a post carrying graduate scale of pay?
    Pls discuss.

    Dear Mr Biswas,
    From your post it is not clear that: –
    1) In 2001 what was the qualification you have shown during your recruitment as an AT of school?
    2) Do you have enhanced your qualification during your service?
    3) If yes, do you have taken permission from the competent authority?
    4) What is your actual intention to appear in SSC with different qualification?
    I firstly like to inform you that I am not an expert to give you proper advice in this matter but being a regular member of this forum I have noticed that those information may help the experts of the matter, to guide you properly.

    Is an asst teacher able to do Ph.D ? What is the procedure to do so? By medical leave can he continue Ph.D? Experienced 7 yrs.

    I also apply for N.O.C ( on Nov, 2015) for the phd admission. Now the School ( also MC ) told that we cant give NOC. School must take permission from DI and after that we will think. My question is, can any institute will make obstruction to do phd ?

    hello,
    I am a asstt.master in govt school I had joined my service in 4700 under ropa2009
    after 8 year i got 8 year benefit too ,then after i completes master degree in same subject.now i have got order to draw higher gp which is same as 8 year benefit i.e 4800 in this situation i am confused because some staff say if i draw this i will not be eligible for 16 years benefit what to do please help me.

    I joined the school in hons/pg post. During joining i was a regular student of m.sc course and i completed part one exam. To complete my part two i pray without pay leave to mc and it was granted by mc.after that i pray m.sc scale which was also granted by DI. Then i draw m.sc scale.my question is i have mc resolution and DI approval, is there any problem i will face in future ? If yes what is the remedy?
