As per ROPA 2009 the upper limit of HRA is Rs. 6000, employee and his/her spouse’s taking together. But if anyone is serving in a private concern, should the rule be prevailed? Please answer this with documents concerned.
Private sector employees are not considered by the Govt. for determining the HRA entitlement of their spouses who are in govt. employ. Rule is very clear. Pls see instructions – “to submit declaration in respect of House Rent Allowance drawn by the wife/Husband of the employee who is in service under the Government of India, or any State Government or any Government Undertaking or any Statutory or Local Body, Educational Institutions etc.“ HRA for Working Couple
My wife is a govt. school teacher where as I am working as private IT engineer.For HRA declaration the school is asking my payslip too. Regarding HRA I have followed this thread and conveyed this message to my spouse.
But from DI office they are asking for my payslip by quoting following memorandum.Now here is a confusion ,which should I follow ? /files/2013/10/HRA.pdf

the DI office is right,u have to submit your payslip/declaration to confirm whether u r getting any kind of HRA or not,yes your HRA is also countable within 6000.
Hello friends, very recently we came to know from some reliable sources that wife of an AT of our school is also an AT of a school. But he has not informed us till now. It may happen that they have not registered their marriage. Even he never said that he is married. Both of them are taking the full HRA from govt. What can we do?

Just issue show cause notice why no departmental proceedings will not be initiated against him/her due to non submission facts which are statutory and inform the higher authority with concrete proof.
