I support digitaldoc for valuable suggestions! Income of spouse who is working in a pvt. co. is not considered for determining the eligibility for HRA of an employee who is in govt., semi-govt./govt. autonomous bodies, local bodies run under govt. fund and non-govt. educational institutions funded by the govt.

For the last three months my college is giving me a reduced HRA than the original amount that i was receiving so long. I need the rules so that I can submit it to my college and claim my HRA as usual.
October 17, 2012 at 4:55 am #74823AnonymousInactiveHRA rules for teachers of aided colleges are same as those applicable for the State Govt. Employees. According to the Dept. of Higher Education Letter No. 533-Edn (CS) 5P-52/98 dated the 28th August, 2009:
“9. Allowances
Allowances viz. Dearness Allowance (DA), House Rent Allowance (HRA) & Medical Allowance (MA) as admissible to the State Govt. Employees from time to time will also be applicable to the incumbent mentioned in the subject.
These are as follows.
(1) House Rent Allowance:
With effect from 1st April, 2009, the House Rent Allowance admissible to an employee will be 15% of his/her revised basic pay i.e. aggregate of the pay in pay band plus academic grade pay in the revised pay structure subject to a maximum of Rs. 6000/- per month. The ceiling of House Rent Allowance drawn by husband and wife together will also be raised to Rs. 6000/- per month.
The existing terms and conditions of drawl of House Rent Allowance by employees living in their own house or in a rental house will continue to apply.
Subject to continuance of the existing terms and conditions regulating drawal of House Rent Allowance by the employees provided with accommodation owned/hired by the Authority and recovery of fixed rent/license fee from time, the following conditions will be there with effect from 1st April, 2009 in respect of such categories of employees.
(a) When an official accommodation being in habitable condition in all respect and such accommodation is earmarked for holder of a particular post without any rent, the holder will not be entitled to House Rent Allowance for living elsewhere.
(b) In case the employee pays rent or license fee for such official accommodation, his reimbursement in the form of I louse Rent Allowance will be limited to actual license fee/rent paid or 15% of the pay whichever is lower.”

Recently i have heard that two orders 4030 F(P) dt 21/5/2013 and 4234 F(P) dt 27/5/2013 were issued which may have an effect on those whose spouse is in private sector..I am not sure..

Hi. I am a school teacher of west bengal govt aid school. I jointed last year. My spouse is working in a U.S based private organisation in IT sector. According to my knowledge if spouse is in private sector (any type of govt funding is not there) then a person can avail the full HRA (upto 6000 Rs). Upto last month I am getting full HRA. But last month only my HM told me to submit my spouse HRA related document and told that if he is getting more than 6000 Rs I will not get any HRA. Please help me in this issue. Since your wife is working in private sector the HRA paid to her should not be taken into account. Get it rectified as soon as possible else you will face various problems in future.

digitaldocThis has changed since Govt Order No. 5839F P DT 9.7.2012 by Finance audit department where private employees has also come under scanner and they will be treated as other deptt like semi govt organisation. in short, the govt trying to reduce its expenditure anyway. link: /files/2013/10/HRA.pdf
