My question to my friends is that whether the leave sanctioning authority can grant E.L if the application along with the medical certificate is made for grant of commuted leaves for absence on sickness? If so under which provision of WBSR he is entitled to do so? Similarly my other question is that whether the leave sanctioning authority can grant EL if the application is made for grant of casual leaves? In one of such incidents in Kolkata Police the leave sanctioning authority has granted Casual Leave when the employee had applied for permission leave for 23 hours on Sunday which is a gazetted holiday in the offices of Government of West Bengal. In an another case, a Muslim employee of Kolkata Police was granted casual leave on the day of Eid festival which was a gazetted holiday in the offices of the Government of West Bengal and he had applied for grant of 4 days E.L prefixing the Eid day as Permission Leave. So far I know he cannot do so under WBSR 155. Whether any such rule or G.O exists in the matter of grant of leave? Whether the leave sanctioning authority has got any discretionary power to grant the leave of the type which has not been applied for by the employee? I would also like to be enlightened by my friends of this forum about the remedy available to an employee of Kolkata Police for such a harassing attitude by the leave sanctioning authority. This is a very urgent matter and I hope that my friends and seniors will give me the appropriate advice quoting the rules under which the leave sanctioning authority of Kolkata Police is indulging in such acts.
