Will Govt. gives us life security????????? & What about the transport employees?????????? They don’t have their family ????????? They don’t have their life??????????? Why they will take life risk??????? Govt. gives security to every one then pass this type of orders………………. People, who are under 24 hours security, its easy to them to pass such a nonsense comments……………………..

4. Rights—The following shall be the rights of Government employee:—
(1) every Government employee shall have the right to form Associations’, Unions
Federative bodies of the employees;
(2) every Government employee shall have full trade union rights including the right to
strike. The right, to, strike shall, however, be subject to compliance with the provisions
laid down in Appendix;
Note.—The right to strike shall not; now ever, be available to the members of the W.B.C.S.
(Executive and Judicial) and other allied executive, administrative, medical, engineering and
educational services;
(3) every Government employee shall enjoy full democratic rights except being a
member of any political party.
Explanation.—These rights do not however include any which is prohibited under the law of the

Abstaining from or refusal or work : If an employee being present abstains from work or refuses to work at any time on the prescribed hours of work on any day he shall, in addition to being liable to disciplinary action for dereliction of duty be deemed to be absent without leave and shall not be entitled to draw any pay and allowance for such day. [Rule 3B]
Resorting to strike : If an employee resorts to or in any way abets any form of strike for any period, he shall, in addition to being liable to disciplinary action, be deemed to be absent without leave and shall not be entitled to any pay and allowance for such period. The authority empowered to grant leave may either commute retrospectively such period of absence without leave into extraordinary leave without pay as amounting to a break-in-service entailing forfeiture of his past service and may pass orders accordingly. [Rule 3C(a)]

Administration must ensure safety and security of the interested office-goers on strike day. But it appears next to impossible to any administration to comply with this. The activities of the Govt. can neither be arbitrary and/or malafide in any way nor it would be violative of naural justice. There is a basic and very broad difference between a private employee and a Govt. employee. In case of a private service, there must be a contract pursuant to which the fate of the employee is to be determined, but a govt. service is more than a contract and the security of the govt.employee is to be guided by the Service Jurisprudence and also by the various provisions of the Constitution of India as is also embodied in various Supreme Court Judgments too. So in my point of view if the recent W.B. Govt. takes any drastic steps towards the large numbers of employees working under this Govt.,this will not only reveals the arbitrary raj of the Govt. but also may multiply to such an extent, which may put a very serious impact on the face of the democracy and/or humanity too.

Mamata Banerjee and other offers those are making that kind of circular that If any person will come out from his/ her home to attend the Office duties only to save their service, then govt. will assure them about Security for their life? and Mrs C.M. should make commitment to us that her party will never call strike or bandh any way, is it possible for our Bengal? I think NO. because we have seen before that time T.M.C and other party so many times called bandh or strike for long time. so govt. should think about their employee’s problem, should not to do threat, all employees have family, so they have also responsibility to maintain their family, In that way one Government like a family and i think all govt. employee like family members.so I don’t any strike personally but also i don’t agree with this type of order. Govt. should think of it.
