I was appointed on 04/06/1998 to the post of Warder in Jail Department in the Scale of pay Rs 3000-5230/-. thereafter promoted to the post of LDC on 26/09/2005 in the scale 3350-6325/-. On up-gradation of pay scale of Warders to 3350-6325/- vide G.O. No. 4429-F dtd. 08-06-09 notionally w.e.f. 01-01-1996, I was allowed 8 years’ benefit on 04/06/2006. then I opted and was promoted to the post of Assistant Controller (Sub Jailor) on 01/09/2010 in the PB-3 GP Rs. 3600/-. on 01/07/2016 my Basic Pay is Rs. 16040/-in the PB-3 GP Rs. 3600/-
one of my colleague was appointed on 10/12/1998 to the post of Warder. thereafter promoted to the post of LDC on 26/09/2005 in the scale 3350-6325/-. He got 8 years’ benefit on 10/12/2006. he did not opted to be promoted to the post of Assistant Controller and he got 16 years’ benefit w.e.f. 10/12/14. On 28/01/2016 he was promoted to the post of UDC and on 01/07/2016 his pay is fixed to Rs. 16400/- in the pay band 3 including grade pay Rs. 3600/-
In respect of appointment in the basic post/grade – I am senior. In respect of shouldering higher responsibility in the PB – 3 GP Rs. 3600/- I am also senior than the aforesaid employee. moreover, if I opted to be promoted to UDC would be promoted before him as per gradation list.
Am I eligible for pay protection or relief to get identical pay of my aforesaid colleague? please reply as early as possible.
