SC & ST(POA) Act 1989 is a very potent law to safe guard the social security and honour of a SC/ST member. Under this law an accused is not eligible for even anticipatory bail. All the sections of this Act are non-bailable. Under Section 3 if the complaint is made by a SC/ST person against any non SC/ST person for committing the offences which have been defined under the law(even taunting by calling his caste)then this law can be invoked. Section 4 is more dangerous. It says that if the controlling officer or Head of the office who is a non SC/ST person ignores the complaints of SC/ST complainant working in his office then he is also liable for prosecution which is also non bailable and without the provision of anticipatory bail.however, the beauty of this law is that offence committed by a SC/ST accused against a SC/ST person is no offence.
