one police personnel sub inspector of police of west bengal 1998 batch got punishment for proceeding one annual increment stop for four years in the year 2013 and increment has been stop from july 2013. if his batch man got promotion in 2015 whether he is eligible or not. also suggest legal approach in this respect.
He is not eligible for promotion during the currency of the punishment. This means that till the punishment period is over, he would not be considered for promotion. The officer should have appealed if the punishment was disproportionate comparing the degree of misconduct. He can appeal for lessening the punishment on sympathetic ground and /or merit. The appeal should be short(otherwise no one will read it….it is there in all hierarchy of the Govt. of W.B)and too the point. He will be lucky if he gets the reply otherwise I have seen that no one bothers for the lower ranks in police department. I wish him good luck.

pl clarify the following
1.one police personnel got punishment one annual increment stop for four years and another got punishment four increament stop with out future effect.whethere the both punishment is same.if not what is remedy.
2.one police personnel got punishment one annual increment stop for four years .and punishment start from 2013 and he will attend 16 yrs in job in 2014 he did not get 16 yrs benefit.now till 2014 three increament stop and in 2015 one increment will be stop. in such case whethere in the year 2016 he will be fit for promotion.
