    Sub: Implementation of the recommendation of the Shetty Commission for the staff attached to the Establishment of Bench Clerk/ Reader/ Bench Assistant/ Peshkar etc. In the sub-ordinate court in the State – Regarding recruitment rules, promotion policies and qualifications, etc.

    Sir,
    In compliance with direction of the Hon’ble Supreme Court of India dt. 11.2.09 passed in I.A. No.s 71A, 135-136, 137-138 and 142 in w. p. ( c) No. 1022/1989 and as per the decision taken in the matter in the meeting held in the chamber of the Principal Secretary, Finance Department of West Bengal on 30.03.2009, I am directed by order of the Governor to say that the Governor has been pleased to decide to implement the following recommendations w.e.f. 01.04.2003 :-

    (1) There will be three grades of Bench clerks for the three levels of courts namely:
    (i) Bench Clerk-Grade-III, attached to the Court of Civil Judge (Jr. Division/ Magistrate).
    (ii) Bench Clerk-Grade-II, attached to the Court of Civil Judge (Sr. Division/ CJM/ CMM).
    (iii) Bench Clerk-Grade-I, attached to the District Court / Additional District Judge Court.

    (2) Mode of Recruitment:-
    The Bench Clerk are to be appointed generally from the respective cadres in the service and not by restrictive channel of promotion from Bench Clerk-Grade-III to Bench Clerk-Grade-II and Bench Clerk-Grade-II to Bench Clerk-Grade-I.
    If necessary, additional posts may be created.
    (i) Bench Clerk-Grade-III
    Appointment from the Cadre of Officials in the Pay Scale of Rs.4000-8850/-(U.D. Assistants, Bench Clerk, Accountants)
    (ii) Bench Clerk-Grade-II
    Appointment from the Cadre of Officials in the Pay Scale of Rs.4500-9700/-(Head Clerk-cum-Translator, Cashier, Accountants, Nazirs etc.)

    (iii) Bench Clerk-Grade-I
    By promotion from Cadre of Bench Clerk Grade-II, Head Clerk-cum-Translators, Cashiers, Accountant, Nazirs and appointment of Sheristedars of the Courts of Civil Judge (Jr. Div.) to whom the Pay Scale of Rs.4800-10925/- is recommended.
    (3) This order is issued with concurrent of the Finance (A) Department vide there U.O. No. 1561 Gr.’P’ (Service) dt. 01.06.09.
    (4) All concerned including all Treasury Officers, Calcutta Pay & Accounts Office-I & II, W.B. are also informed accordingly.

    (1) Pay Scale of the Bench Clerk Grade-III will be Rs.4000-8,850/-
    (2) Pay Scale of the Bench Clerk Grade-II will be Rs.4500-9,700/-
    (3) Pay Scale of the Bench Clerk Grade-I will be Rs.4,800-10,925/-

    This order is issued with concurrence concurrent of the Finance (A) Deptt. vide there U.O. No. 1561 Gr.’P’ (Service) dt. 01.06.09.
    All concerned including all Treasury Officers, Calcutta Pay & Accounts Office-I & II, W.B. are also informed accordingly.
