May I request the Hon’ble members to post the recruitment rules of contractual employees(and not re-employment) of Government of West Bengal for appointments in Hospitals against the vacancies in the ranks of Doctors,Nurses, and paramedical staff. This is very urgent. Co-operation of all is needed.

Infact I am not aware of any such G.O.or Rule but contractual employments are taking place in Government organisations.I am interested in knowing the contents of the Rules or G.O under which Govt. of West Bengal is giving contractual employment and also about the conditions of service of those employees.

I am in need of the recruitment rules of the contractual employees. Even if it is not connected with the Health Department any other department rule would be helpful to understand the basics. There is nothing on contractual employment rules on Labour Department web site.

MEMORANDUM
For sometime past, the Stale Government has been following the policy of filling up non-P.S.C. / non-promotional posts on contract basis generally for one year initially with Ihe approval of the appointments committee cf the Cabinet (ACC) In each individual case. The contractual appointment of these employees are also being renewed from time to time, Since, however, the job attached In these Posts are perennial in nature, The above policy has been reviewed. On the basis of review, the Governor has beer pleased to decide as under:
(i) The non-P.S.C./non-promotional posts, in general, may be filled up an regular basis with the approval of Finance Deptt and the ACC For this purpose, steps should be taken for filling up of the vacant pasts following the usual rules and methods of recruitment for the posts.
(ii) There shall be no further appointment on contract basis against regular vacancies or engagement of private agencies for getting the jobs associated with regular posts done, except in the following cases, where,
(a) the posts are required to be filled up exclusively for time bound projects,
(b) the posts require specialized, scientific or technical qualification, and
(c) the situations are of specific exigencies as may be decided by the Cabinet.
2. The Governor has been further pleased to decide that the employees who were initially recruited on contract basis following the norms, rules and methods as applicable to the relevant Posts, may, if still continuing in contract service, be brought under the regular establishment, subject to the above principles, against regular vacancies in which they have been initially appointed with the approval of ACC. consultation with the Finance Department will be necessary in such cases.

MEMORANDUM
In continuation of this Department’s Memorandum No. 8305-F, dated 26.9.2005, the undersigned is directed by order of the Governor to say that the decisions of regular appointment against regular vacancies under the Government in respect of those employees who were initially recruited on contract basis following the norms, rules and methods as applicable to relevant posts and with the approval of the A C C and still continuing as such shall also apply mutatis mutandis in case of similar contractual appointments against regular posts under the Statutory Bodies including Local Bodies, Autonomous Bodies, Non-Government Aided Educational Institutions and undertakings owned or substantially controlled by the State Government with the approval of ACC Consultation with the Finance Department will be necessary in such cases.
