I am a retired INDIAN AIR FORCE officer , I applied for and got allotment of a flat in a AIRFORCE NAVAL HOUSING BOARD (AFNHB ) project in RAJARHAT . I registered a SUB LEASE for the flat.The land was obtained by AFNHB from HIDCO on lease for 99 years . The lease deed between HIDCO and AFNHB mentions in of the paragraphs that” the piece and parcel of land is being allotted for constructing building for defence personnel “. This is being quoted as a condition for restricting transfer of the flat to any civilian . There is no specific mention of RESTRICTION of TRANSFER in the LEASE or SUB LEASE.
What is the relevant rule/law in WEST BENGAL on the subject . The TRANSFER OF PROPERTY ACT 1882 does not have any mention of CONDITION/CONDITIONAL .
Can you please educate .
