West Bengal Incentive Scheme 2023 for Broiler Breeding Farms

NOTIFICATION

WHEREAS the State occupies a significant position in the poultry sector in the country but the production of broiler chicks within the State needs to be enhanced;

AND WHEREAS, in order to reduce the gap between demand and supply of broiler chicks, the State Government has emphasized production of broiler chicks within the State by promoting the setting up of broiler breeding farms;

THEREFORE, the State Government considers it necessary and expedient to extend special financial assistance for encouraging entrepreneurs to set up broiler breeding farms in order to enhance broiler chick production and generate employment opportunities within the State.

Now therefore, the Governor is pleased to approve and sanction a special incentive scheme for setting up new ventures/ projects/ enterprises engaged in Broiler Breeding Farm activity:

1. Short Title:

This Scheme may be called the West Bengal Incentive Scheme 2023 for Broiler Breeding Farms (hereinafter referred to as WBIS 2023 for BBFs).

2. Object:

The object of the Scheme is to extend special financial incentives to encourage entrepreneurs to set up Broiler Breeding Farms with a view to promote production of broiler day-old chicks in the State and create employment opportunities in rural areas, to make the State self-sufficient in broiler day-old chicks production.

3. Commencement and Duration:

Unless specifically mentioned against the respective incentives sanctioned under the WBIS 2023 for BBFs, the Scheme comes into effect on and from the 1st day of September, 2023 in the whole of West Bengal except in areas falling under Municipal Corporations or Municipalities and shall remain in force for a period of two years, ending on 31st August 2025, if not withdrawn/ amended earlier.

4. Definitions:

In the WBIS 2023 for BBFs, unless the context otherwise requires:

(i) “Approved Location” means a location where a farm has been set up and commenced commercial activity with site clearance from local body/ WBPCB as the case may be.

(ii) “Approved Project” means a project for broiler breeding farm that has been approved by the ARD Department, Government of West Bengal.

(iii) “ARD” means Animal Resources Development.

(iv) “Broiler Breeding Farm” means a farm engaged in activity of producing fertilized broiler hatching eggs from parent broiler poultry birds with integrated facility to hatch fertilized eggs to produce Day-old broiler chicks.

(v) “Central Government” means the Government of India.

(vi) “Date of commencement of commercial activity” means – For broiler breeding farm – the date on which DOC (first hatch) emerges from fertilized eggs derived from at least one-fifth of parent broiler poultry birds of approved farm size.

(vii) “Deputy Director, ARD & PO” refers to the Deputy Director ARD having jurisdiction over the area where the farm is located/ proposed to be set up.

(viii) “DOC” means Day Old Chicks of broiler poultry birds.

(ix) “Eligible farm” means a farm eligible as per terms and conditions of WBIS-2023 for BBFs.

(x) “Existing farm” means a farm which exists in West Bengal before 1st September, 2023.

(xi) “Expanded portion” means the portion expanded with minimum additional size as mentioned in para 4(xii) on or after 1st September, 2023 in an Approved Project.

(xii) “Expansion of existing farm” means addition to existing size of the same activity of the farm by at least 10,000 broiler parent birds in an Approved Project in the existing location or in a different location.

(xiii) “Farm” means broiler breeding farm.

a. “Micro Farm” means a farm with minimum capacity of 10,000 broiler parent poultry birds and up to 20,000 broiler parent poultry birds.

b. “Small Farm” means a farm with more than 20,000 broiler parent poultry birds and up to 1,00,000 broiler parent poultry birds.

c. “Medium Farm” means a farm with more than 1,00,000 broiler parent poultry birds.

Explanation: If a farm’s size is such that it falls between any two consecutive multiples of 10,000, the lower multiple will be considered as the size of the farm.

(xiv) “New farm” means a farm which has been established & commenced commercial activity for the first time In the State on or after 1st September, 2023.

(xv) “State” means the State of West Bengal.

(xvi) “State Financial Corporation” means West Bengal Financial Corporation (WBFC).

(xvii) “State Government” means the Government of West Bengal.

(xviii) “Term Loan” means a loan secured from any Commercial Bank/ Financial Institution (Central or State)/ Co-Operative Bank/ Scheduled Bank/ RRBs approved by RBI for acquiring fixed capital assets in the form of land, building, plant and machinery, tools & implements, appliances, cost of chicks & its rearing cost upto point of lay as per approved project.

(xix) “Working Capital” means capital required for running a farm and includes cash credit and/ or any other short term loan actually utilized as working capital.

(xx) “Year” means, unless otherwise specifically mentioned and not repugnant to the context, the financial year commencing from the 1st April and ending on the 31st March following.

5. Applicability of WBIS 2023 for BBFs:

(i) The WBIS 2023 for BBFs shall be applicable for a new farm or expanded portion of existing farm in Micro, Small or Medium sector as defined in Para 4 Sub Para (xiii) in the whole of West Bengal except areas falling under Municipal Corporations or Municipalities.

(ii) The farms may be in the private sector (individual, partnership, private limited company, trust etc.) or in the cooperative sector.

6. Non-applicability of WBIS 2023 for BBFs:

(i) The WBIS 2023 for BBFs shall not be applicable for a new farm having farm size less than 10,000 broiler parent poultry.

(ii) The WBIS 2023 for BBFs shall also not be applicable for expansion of existing farms that do not satisfy the definitions under Para 4.

(iii) The WBIS 2023 for BBFs shall not be applicable to a new farm as also to expansion of existing farm that commenced commercial activity before September, 2023.

7. Eligibility criteria for incentives under WBIS 2023 for BBFs:

A broiler breeding farm shall be eligible for incentive under WBIS 2023 for BBFs subject to fulfillment of the conditions specified below –

(i) The broiler breeding farm shall establish & commence its commercial activity within the period of the Scheme and shall have to submit its first incentive application not later than 7 months from the last date of the Scheme period.

Explanation – For a broiler breeding farm which will establish & commence its activity in the scheme period 01.09.2023 to 31.08.2025, the last date of submission of first incentive application to the Deputy Director, ARD & PO of the concerned district will be 31.03.2026.

(ii) The project must be an Approved Project as defined under Para (4), Sub Para (ii).

(iii) The project should indicate the source of fund required for implementation of approved project.

(iv) The farm will submit a ‘self-declaration’ affirming:

a. That the farm will strictly observe/ obtain requisite statutory compiiances/ clearances including pollution control measures, if applicable.

b. That the farm will follow labour laws.

c. That the farm will remain in operation for at least five years from the date of commencement of commercial activity.

d. That the farm has not defaulted in payment of any government dues/dues of Financial Institutions or bank.

e. That the farm has not misrepresented or withheld any information and not suppressed any fact/ information related to the claim submitted.

f. That all documents like approved project report etc. submitted by the farm with the claim are genuine.

g. That the farm will not divert/ utilize the loan amount disbursed by the bank/ financial institution (if applicable) for carrying out any activity/ project other than the implementation of the approved project for which the loan was sanctioned.

(v) The farm will first make primary application in prescribed form, to the Deputy Director, ARD & PO of the concerned District.

(vi) The farm will make application in prescribed form to the Deputy Director, ARD & PO of the concerned District after commencement of commercial activity for grant of incentives under the Scheme.

8. Capital Grant:

An eligible farm will be entitled to a grant of Rs. 8,00,000 for every 10,000 broiler parent poultry birds, subject to a ceiling of Rs. 80,00,000, in at most two phases based on the following criteria in an approved project:

(i) Minimum 20 % parent broiler birds (of an approved project) are in laying stage and the farm has started producing day old broiler chicks from fertilized eggs of parent broiler birds: 50% of eligible & admissible amount of grant.

(ii) Minimum 80% of parent broiler birds (of an approved project) are in laying stage and the farm has started producing day old broiler chicks from fertilized eggs of parent broiler birds: Remaining 50% of the eligible & admissible grant or 100% of eligible grant whichever is applicable.

9. Interest Subsidy on Term Loan:

(i) An eligible farm will be entitled to avail Interest Subsidy on annual interest liability on the Term Loan borrowed from a Commercial Bank/ Cooperative Bank/ Scheduled Banks/ RRBs approved by RBI or from Financial Institution (Central or State) for implementation of the approved project as follows:

a. Micro and Small Farm: The interest subsidy will be 40% of total interest paid on term loan for 5 years from the date of commencement of commercial activity subject to maximum loan amount of 75% of the approved project cost.

b. Medium Farm: The interest subsidy will be 25% of total interest paid on term loan for 5 years from the date of commencement of commercial activity subject to maximum loan amount of 75% of the approved project cost.

(ii) The interest subsidy will be payable annually subject to submission of a statement/ certificate (In Annexure-1) by the lending Bank/ Financial Institution to substantiate that the farm has paid the due interest to the institution on the due dates and has not defaulted in payment of interest at any time during the period.

10. Waiver of Electricity Duty:

An eligible farm for its approved project will be entitled to waiver of Electricity Dub, on the electricity consumed for the manufacturing activity as follows subject :o installation of separate Electric Meter for the approved new/ extended project:

Micro, Small and Medium Farm – 75% for 5 years from date of commencement of commercial activity subject to maximum Rs. 2 lakh per year.

11. Power Subsidy:

An eligible farm for its approved project will be entitled to power subsidy on the electricity consumed for the activity in approved project as follows, subject to installation of separate Electric Meter for the approved new/ extended project:

(i) Micro and Small Farm: Subsidy of Rs. 1.50 per kWh for 5 years from date of commencement of commercial activity subject to maximum Rs. 5 lakh per year.

(ii) Medium Farm: Subsidy of Re. 1 per kWh for 5 years from date of commencement of commercial activity subject to maximum Rs. 10 lakh per year.

12. Subsidy on Stamp Duty and Registration Fee:

(i) An eligible farm will be entitled to 50% reimbursement of Stamp Duty and Registration Fee paid by it for the purpose of registration of documents within the State relating to purchase of land for setting up the approved project.

(ii) The amount admissible will be calculated proportionately based on the percentage of land used for setting up of the farm for implementation of the approved project. However, the total land used for the project shall not exceed the quantum of land shown in the approved project.

13. Power to amend and/or relax/issue clarification:

Notwithstanding anything contained in any of the provisions of WBIS 2023 for BFFs, the State Government may at any time-

(i) modify, vary, alter, amend or withdraw any of the provisions made in this Scheme and such modifications, variations, alterations, amendments and withdrawal shall be effective from the date specified in the order so made in this behalf.

(ii) make any relaxation in applying the provisions of this Scheme but such relaxation shall be made on merits of the approved project in each case, as the State Government may consider necessary and appropriate.

(iii) may issue instructions, clarifications and guidelines to facilitate implementation, to remove anomalies and to clarify on the interpretation of the provisions of this Scheme.

The West Bengal Incentive Scheme 2023 for Broiler Breeding Farms has the concurrence of the Finance Department vide their U.O. No. Group A-I/2023-2024/0108 dated 08.09.2023.

OPERATIONAL PROCEDURES OF WEST BENGAL INCENTIVE SCHEME 2023 FOR BROILER BREEDING FARMS –

1. A primary application shall be made by the willing private entrepreneurs/co-operatives for establishing a new broiler breeding farm or expansion of the existing broiler breeding farm in the State to the Deputy Director, ARD & PO of the concerned district in Form-A.

2. Deputy Director, ARD & PO of the concerned district, after receiving the primary application from the concerned farm, shall cause field inspection, within 7 days after receipt of application and make an inspection note in Form-A.

3. Deputy Director, ARD & PO of the concerned district shall send a copy of Form-A having Inspection Note to the Director, AH&VS, West Bengal for information.

4. A Micro, Small or Medium Farm claiming to be eligible for incentive/ subsidies under WBIS 2023 for Broiler Breeding Farms shall duly apply to the Deputy Director, ARD & PO of the concerned district in Form-B and for Waiver of Electricity Duty in Form-C (both in duplicate).

5. On receipt of application for incentive/ subsidies in Form-B from a farm, the Deputy Director, ARD & PO shall check the completeness of the application form and required documents.

6. In case of incomplete application, Deputy Director, ARD & PO of the concerned district shall intimate the applicant farm regarding deficiency of the application form/ accompanying documents within 15 days from the date of receipt of the application.

7. Deputy Director, ARD & PO and one representative of the District Magistrate of the concerned district, after receiving the complete application from the concerned farm, will then cause field inspection, within 15 days after receipt of complete application, to ensure that the project has been implemented as par approved project and ascertain the size of the farm and actual date of commencement of commercial activity and on being satisfied will provisionally recommend in Form-D to the District Committee for Incentive under WBIS 2023 for Broiler Breeding farms within 15 working days after field inspection.

8. Deputy Director ARD & PO of the concerned district will maintain records containing details of all application including inspection details, recommendation and release/ disbursement of Fund.

9. The District Committee for Incentive under WBIS 2023 for Broiler Breeding Farms comprises –

  • District Magistrate/ Addl. District Magistrate – Chairman
  • Deputy Director ARD & PO – Convener
  • One Officer from WBA&AS as nominated by District Magistrate – Member
  • District Veterinary Officer – Member
  • One Assistant Director of ARD posted in the District as decided by the DD ARD & PO – Member

10. The District Committee will recommend for approval of the admissible incentive/ subsidies under WBIS 2023 for Broiler Breeding Farms, in Form – E.

11. If any application is found to be not eligible for incentive/ subsidies under the WBIS 2023 for BBFs at any stage, Deputy Director ARD & PO of the concerned district will inform the applicant farm along with reasons.

12. The Deputy Director ARD & PO of the concerned district shall send a copy of Application Form (Form-B) of the farm for incentive/subsidies along with ell documents, Form for Waiver of Electricity Duty (Form-C), Provisional Recommendation Form (Form-D), and copy of resolution having the recommendation for approval (Form-E) of admissible incentive/ subsidies of the District Committee to the Director, AH&VS, West Bengal, for approval of admissible incentive/ subsidies.

13. Departmental Committee for sanctioning of Incentive under WBIS 2023 for Broiler Breeding Farms comprises –

  • Additional Chief Secretary ARDD or Officer nominated by them -Chairman
  • One Special Secretary, ARDD – Member
  • Director, AH&VS, WB – Convener
  • Financial Adviser of the Department – Member

14. After approval, Director, AH&VS, West Bengal will release fund to the District for payment of incentive/ subsidies to the entrepreneurs and recommend the case to the Director, Directorate of Electricity Duty in Form-F along with Form-C for Waiver of Electricity Duty.

15. On receiving the allotment of funds for the purpose of disbursement of approved incentive/ subsidies to a farm, the Deputy Director ARD & PO of the concerned district shall require the farm concerned to submit a ‘self-declaration’ to the effect that

(i) if the incentive/ subsidy has been claimed by misrepresentation or by furnishing false information OR the farm is shifted from this State to outside the State OR the farm discontinues production in respect of its approved project within 5 (five) years from the date of commencement of commercial activity OR the farm is sold out without prior permission of the State Government OR the loan amount disbursed by Bank/ Financial Institution for the approved project is found to be diverted/ utiIized for some other activities/ projects, the farm shall be liable to refund the entire amount of incentive/ subsidy and in case of failure to refund, the entire amount shall be recoverable under the Public Demands Recovery (PDR) Act.

AND

(ii) If any amount of subsidy/ incentive is paid in excess of the entitlement of the farm detected afterwards, the farm will be liable to refund the same failing which the amount shall be recoverable under the PDR Act.

16. After satisfaction as to submission of ‘self-declaration’ as stated above, the Deputy Director ARD & PO of the concerned district shall disburse the incentive/subsidies to the Bank Account of the said farm with an intimation to the farm.

17. The Deputy Director ARD & PO of the concerned district will maintain a register for all such projects and keep records of all applications received under WBIS 2023 for BBFs.

18. The Deputy Director ARD & PO of the concerned district will also maintain a disbursement register for the purpose of keeping farm wise records of all disbursement made under WBIS 2023 for BBFs.
