NOTIFICATION

In exercise of the power conferred by clause (3) of article 166 of the Constitution of India, the Governor is pleased hereby to make the following amendments in the West Bengal Rules of Business, as subsequently amended (hereinafter referred to as the said rules):-

Amendments

In the First Schedule to the said rules, under the heading “Departments”,

(1) for the entries relating to item “VIII” substitute the following entries “Department of Industry, Commerce & Enterprises”;

(2) Omit item “XIX” and the entries relating thereto;

In the First Schedule to the said rules, under the heading “Allocation of business among departments”,

(3) for the sub heading “VIII. DEPARTMENT OF LARGE INDUSTRIES AND ENTERPRISES” and items and entries appearing thereunder, substitute the following sub-heading, items and entries;

“VIII. DEPARTMENT OF INDUSTRY, COMMERCE & ENTERPRISES.

PART I

1. Promotion, facilitation and regulation of industry, trade and commerce in the State save as otherwise provided, including Micro, Small and Medium Enterprises and Textiles.

2. Management and control over the entire Nayachar Island.

3. Revival & Regulation of-

(a) closed industrial units and trading corporations in the State;

(b) sick industrial units and trading corporations in the State;

4. To govern the West Bengal Industrial Renewal Scheme, 2001 as envisaged in items (3) (a) and (3) (b) under this part.

5. To govern and administer the West Bengal Relief Undertakings (Special Provision) Act, 1972.

6. Regulation and control of supply and distribution of paraffin wax.

7. Matters connected with Government Companies, Boards, Co-operative Societies and Public Undertakings with which the department is concerned.

8. Review, scrutiny and evaluation of financial viability of Government Corporations, and preparation of panel of Managing Directors for such Corporations or Companies.

9. Restructuring of all Public Sector Enterprises under the administrative control of different Departments, except the restructuring the Public Sector Enterprises namely (a) Shalimar Works (1980) Limited, (b) Electro Medical and Allied Industries Limited, (c) West Bengal State Warehousing Corporation, (d) Eastern Distilleries and Chemicals Limited, (e) Mackintosh Bum Limited, (f) Westinghouse Saxby Farmer Limited and (g) Britannia Engineering Limited.

10. All matters connected with Public Enterprises Cell.

PART – II

1. Regulation of mines and mineral development subject to the provisions of List I with respect to regulation and development under Union control (entry 23 of List II).

2. Industries with which the department is concerned, subject to the provisions of entry 52 of List I (entry 24 of List II).

3. Gas and gas works (entry 25 of List II).

4. Trade and commerce within the State excluding sericulture subject to the provisions of entry 33 of List H I (entry 26 of List II).

5. Production, supply and distribution of goods so far as the department is concerned subject to the provisions of entry 33 of List III (entry 27 of List 11).

6. Incorporation, regulation and winding up of corporations other than those specified in List I and Universities; unincorporated trading, literary, scientific, religious and other societies and associations (entry 32 of List II).

7. State public services with which the department is concerned (entry 41 of List II).

8. Tolls in respect of any matters with which the department is concerned (entry 59 of List II).

9. Offences against laws with respect to any of the matters in List II with which the department is concerned (entry 64 of List II).

10. Fees in respect of any of the matters in List II with which the department is concerned but not including fees taken in any court (entry 66 of List II).

11. Partnership contracts with which the department is concerned (entry 7 of List III),

12. Economic planning so far as this department is concerned (entry 20 of List III).

13. Commercial and industrial monopolies, combines and trusts (entry 21 of List III).

14. Profession with which the department is concerned (entry 26 of List III).

15. Trade and commerce in, and the production, supply and distribution of the products of industries where the control of such industries by the Union is declared by or under law made by Parliament to be expedient in the public interest, so far as the department is concerned (entry 33 of List III).

16. Price control, in respect of matters dealt with by this department (entry 34 of List III),

17. Books and printing presses so far as paper control orders are concerned. West Bengal Government Press (entry 39 of List III).

18. Inquiries and statistics for the purposes of any of the matters specified in List II or List III with which the department is concerned (entry 45 of List III).

19. Fees in respect of any of the matters in List III with which the department is concerned, but not including fees taken in any Court (entry 47 of List III).

PART- III

1. Explosives (entry 5 of List I).

2. Atomic energy and mineral resources necessary for its production (entry 6 of List I).

3. Industries declared by or under law made by Parliament to be necessary for the purpose of defence or for prosecution of war, so far as the department is concerned (entry 7 of List I).

4. Participation in international conferences, associations and other bodies and implementing of decisions thereat so far as the department is concerned (entry 13 of List I).

5. Entering into treaties and agreements with foreign countries and implementing the treaties, agreements and conventions with foreign countries so far as the department is concerned (entry 14 of List I).

6. Shipping and navigation on inland waterways, declared by Parliament by law to be national waterways, as regards mechanically propelled vehicles; the rule of the road on such waterways (entry 24 of List I).

7. Maritime shipping and navigation, including shipping and navigation on tidal waters; provision of education and training for the mercantile marine and regulation of such education and training provided by States and other agencies (entry 25 of List I).

8. Ports declared by or under law made by Parliament or existing law to be major ports, including their delimitation, and the constitution and powers of port authorities therein (entry 27 of List I).

9. Posts and telegraphs; wireless, broadcasting and other like forms of communications (entry 31 of List I).

10. Post Office Savings Bank (entry 39 of List I).

11. Trade and commerce with foreign countries; import and export across customs frontiers; definition of customs frontiers, so far as the department is concerned (entry 41 of List I).

12. Inter state trade and commerce, so far as the department is concerned (entry 42 of List I).

13. Incorporation regulation and winding up of trading corporations including banking insurance and financial corporations but not including co-operative societies (entry 43 of List I).

14. Insurance (entry 47 of List I).

15. Stock exchanges and future markets (entry 48 of List I).

16. Patents, inventions and designs; copyright; trademarks and merchandise marks, so far as the department is concerned (entry 49 of List I).

17. Establishment of standards of quality for goods to be exported out of India or transported from one State to another, so far as the department is concerned (entry 51 of List I).

18. Industries, the control of which by the Union is declared by Parliament by law to be expedient in the public interest, so far as the department is concerned (entry 52 of List I).

19. Regulation and development of oil fields and mineral oil resources; petroleum and petroleum products excluding their supply, distribution and rationing; other liquids and substances declared by parliament by law to be dangerously inflammable (entry 53 of List I).

20. Regulation of mines and mineral development to the extent to which such regulation and development under the control of the Union is declared by or under law made by Parliament to be expedient in the public interest (entry 54 of List I).

21. Manufacture, supply and distribution of salt by Union agencies; regulation and control of manufacture supply and distribution of salt by other agencies (entry 58 of List I).

22. Institutions for scientific or technical education financed by the Government of India wholly or in part and declared by or under law made by parliament to be institutions of national importance (in respect of matters with which the department is concerned) (entry 64 of List I).

23. Union agencies and institutions for-

(a) Professional, vocational or technical training; or

(b) The promotion of special studies or research;

– so far as subject dealt with or services administered by the department are concerned (entry 65 of List I).

24. The Geological Survey of India (entry 68 of List I).

25. Union public services in respect of matters with which the department is concerned (entry 70 of List I).

26. Offences against laws with respect to any of the matters in List I with which the department is concerned (entry 93 of List I).

27. Inquiries, surveys and statistics for the purpose of any of the matters in List I with which the department is concerned (entry 94 of List I).

28. Admiralty jurisdiction (entry 95 of List I).

29. Fees in respect of any of the matter in List I (but not including fees taken in any Court) with which the department is concerned (entry 96 of List I).”

(4) under subheading “XXXVIII. DEPARTMENT OF PARLIAMENTARY AFFAIRS”,

in Part I, for item 4 and the entries relating thereto, substitute the following item and entries:-

“4. Matters relating to the establishment of the Legislative Assembly Secretariat and its administrative arrangement.”

(5) Omit the sub-heading “XIX. DEPARTMENT OF MICRO, SMALL AND MEDIUM ENTERPRISES AND TEXTILES” and items and entries appearing thereunder.
