Sub.: Duration of Defect Liability Period in road works

It has been observed that different officers under Public Works Department are considering different period of Defect Liability for the road works under the Department.

Now, after careful consideration of the matter, it has been decided to adopt norms followed by Ministry of Road Transport and highways vide their letter No. NH-11065/4/2012- P&M (Pt-II) dated 12th October,2012 with some modification.

a) For repair and maintenance nature of bituminous road work or combination thereof the Defect Liability period should be considered as one year.

b) For original nature of bituminous road work, the Defect Liability period should be 3 years from the date of completion in case where the bituminous thickness is equal to or more than 40 mm. However, in case of works where bituminous thickness is less than 40 mm, the Defect Liability period is 1 year from the date of completion.
