Sub: Regarding Joining and Release of Teaching and Non-teaching Staff (on transfer) of Govt. Aided Recognized Madrasahs of the State.
With reference to the subject mentioned above, this is to state that the Hon’ble Supreme Court of India in its final and solemn order dated 06.01.2020 in connection with Civil Appeal No. 5808 of 2017 read with SLP(C) 6661/2016 has declared the West Bengal Madrasah Service Commission Act as constitutional and has held that all recruitments and transfers for Teaching and Non-teaching posts are to be made by the West Bengal Madrasah Service Commission. Accordingly, the West Bengal Madrasah Service Commission has issued recommendation letters to the eligible Assistant Teachers/ Non teaching staff of different Govt Aided Recognized Madrasahs in connection with General Transfer.
But, it has come to the notice of the undersigned as also a number of complaints have been received from Assistant Teachers that a number of Madrasah Authorities are not allowing those eligible Assistant Teachers/ Non teaching staff who have been recommended for General Transfer by the West Bengal Madrasah Service Commission to join or release from the Madrasahs in different pretext or other reasons under the jurisdiction of his/her district.
Under the above mentioned facts and circumstances, he/she is requested to instruct the Madrasah Authorities to take necessary action immediately to join or release from the Madrasahs of his/her jurisdiction. The Headmaster/ Headmistress/ Superintendent/ Teacher in Charge who will fail to act as per orders, circulars and recommendations of the Government should be show caused for dereliction of duty and legal action should be taken against the concerned Headmaster/ Headmistress/ Superintendent/ Teacher-in Charge for insubordination including stop of salary w.e.f. August, 2022, if they intentionally and wilfully violate the recommendation of the West Bengal Madrasah Service Commission/ order of the Government. This may be brought to the notice of all Headmaster/ Headmistress/ Superintendent/ Teacher-in-Charge.
This be treated as URGENT.
