Recruitment Rules for Engineering Services (Mechanical and Electrical) under IWD

NOTIFICATION

In exercise of power conferred by the proviso to Article 309 of the Constitution of India, the Governor is pleased hereby to make, in supersession of all previous rules on the subject, the following rules regulating the recruitment to the Engineering Services (Mechanical & Electrical) under the Irrigation & Waterways Department, Government of West Bengal:

RULES

1. These rules may be called the rules regulating the recruitment to the Engineering Services (Mechanical & Electrical) under the Irrigation & Waterways Department, Government of West Bengal.

2. These rules shall be deemed to have taken effect from the 1st day of April, 1984.

PART – I
Cadre

3. There shall be the following three services, namely:

(a) West Bengal Senior Service of Engineers (Mechanical & Electrical) consisting of the posts of Chief Engineer (Mechanical & Electrical), Superintending Engineer (Mechanical & Electrical) and Executive Engineer (Mechanical & Electrical) including the posts of Technical Assistant to the Superintending Engineer,

(b) West Bengal Service of Engineers (Mechanical & Electrical) consisting of the posts of Assistant Engineer (Mechanical & Electrical),

(c) West Bengal Subordinate Engineering Service (Mechanical & Electrical) consisting of the I posts of Sub-Assistant Engineer (Mechanical & Electrical).

PART – II
Method of Recruitment & Qualifications

[A] West Bengal Senior Service of Engineers (Mechanical & Electrical)

I. Chief Engineer

4. The posts of Chief Engineer (Mechanical & Electrical) shall be filled up by promotion from the rank of Superintending Engineer (Mechanical & Electrical).

II. Superintending Engineer

5. The posts of Superintending Engineer shall be filled up by promotion from the rank of Executive Engineer (Mechanical & Electrical).

III. Executive Engineer (Mechanical & Electrical) including The Technical Assistant to the Superintending Engineer

6. (1) Subject to the provisions of sub-rule (2), the posts of Executive Engineer (Mechanical & Electrical) including the posts of Technical Assistant to the Superintending Engineer, shall ordinarily be filled up by promotion from the rank of Assistant Engineer (Mechanical & Electrical), provided that if sufficient number of Assistant Engineers (Mechanical & Electrical) suitable for such promotion be not available at any time, the posts may be filled up by direct recruitment, departmental candidates being eligible to apply.

Qualifications for Direct Recruitment

(i) A degree in Mechanical or Electrical Engineering from a recognised University or its equivalent.

(ii) Six years’ experience in the field of Mechanical or Electrical Engineering.

Age

Not more than 40 years on the 1st January of the year of advertisement.

(2) Notwithstanding anything contained in any other rule, an Assistant Engineer (Mechanical or Electrical) shall be eligible for promotion to the rank of Executive Engineer after he has completed 6 (six) years of service as Assistant Engineer (Mechanical or Electrical) and has passed the Departmental and Professional Examination referred to respectively in Chapters V and VI of the Services (Training and Examination) Rules, West Bengal, at any stage of his service.

[B] West Bengal Service of Engineers (Mechanical & Electrical)

7. Recruitment to the posts of Assistant Engineer (Mechanical & Electrical), shall be made as follows:

(a) 60% of the posts of Assistant Engineer (Mechanical & Electrical), permanent and temporary taken together, shall be filled up by direct recruitment on the results of a competitive examination to be conducted by the Public Service Commission, West Bengal provided that the Governor may, in the exigencies of Public Service, fill up such posts by selection after advertisement and interview instead of by a competitive examination through the Public Service Commission, West Bengal.

(b) The remaining 40% of the posts of Assistant Engineer (Mechanical & Electrical), permanent and temporary taken together shall, subject to the provisions of clause (d), be filled up by promotion from amongst the confirmed Sub-Assistant Engineers (Mechanical & Electrical) by selection through the Public Service Commission, West Bengal, provided that if, on any occasion, suitable departmental candidates for promotion be not available, the Government may, in the exigencies of Public Service, fill up such posts by direct recruitment through the Public Service Commission, West Bengal, in the manner provided in Clause (a) above.

(c) Qualifications for direct recruitment to the posts of Assistant Engineer (Mechanical & Electrical) shall be as follows:

(i) Essential

A degree in Mechanical Engineering or Electrical Engineering of a recognised University or its equivalent qualification.

(ii) Desirable

One year’s Post-Graduate practical training or study or research or practical engineering experience.

(iii) Age

Not more than 27 years on the first day of January of the year of advertisement, the age limit being relaxable, in the case of candidates who have been In the employment of the Central or the State Government or any Statutory Body recognised for the purpose by the Government and are not out of such employment for more than a year on the said date, to the extent of the actual period spent continuously in such employment. No relaxation of age-limit shall be allowed to a candidate who has already appeared in the examination thrice.

Note: No candidate shall be allowed to take more than three chances. The departmental candidates are eligible to apply, provided they fulfil the requisite qualifications.

(d) In order to be eligible for promotion to the rank of Assistant Engineer (Mechanical & Electrical), a Sub-Assistant Engineer (Mechanical & Electrical) must fulfil the following conditions:

(i) He must render a minimum of 10 (ten) years’ continuous service as a Sub-Assistant Engineer (Mechanical or Electrical) in the regular establishment under the Irrigation & Waterways Department, Government of West Bengal.

(ii) He must be confirmed in the post of Sub-Assistant Engineer (Mechanical or Electrical), and

(iii) He must pass an examination, conducted by the Public Service Commission, West Bengal, which willbe of the same standard as the professional examination referred to in Chapter-VI of the Services (Training and Examination) Rules, West Bengal, provided that a Sub-Assistant Engineer who has rendered a minimum of 8 years’ service including temporary service in a post of Sub Assistant Engineer (Mechanical or Electrical) in the regular establishment shall be eligible for appearing at the said examination.

[C] West Bengal Subordinate Engineering Service (Mechanical & Electrical)

8. Recruitment to the posts of Sub-Assistant Engineer (Mechanical & Electrical) shall be made by the Director of Personnel & Ex-officio Chief Engineer, Irrigation & Waterways Directorate, Government of West Bengal, by selection from amongst the candidates possessing the following qualifications:

(i) Essential

Diploma in Mechanical or Electrical Engineering or its equivalent.

(ii) Desirable

One year’s practical training after completion of the course.

(iii) Age

Not more than 30 years on the first day of January of the year of advertisement, the age limit being relaxable, in the case of candidates who have been in the employment of the Central or the State Government or any Statutory Body recognised for the purpose by the Government and are not out of such employment for more than a year on the said date, to the extent of actual period spent continuously in such employment.

PART – III
Transitional Provisions

9. (1) Notwithstanding the provisions of sub-rule (2) of Rule 6, if any Assistant Engineer (Mechanical or Electrical), who has not passed the Departmental Examination referred to therein prior to the commencement of these rules but is otherwise eligible and suitable for promotion to the rank of Executive Engineer (Mechanical or Electrical) under these rules, may be promoted to the rank of Executive Engineer (Mechanical or Electrical) provisionally, subject to the condition that he shall have to pass the said departmental examination within a period of two years from the date of such provisional promotion and upon his failure to pass the said examination within the said period of two years, he shall be reverted to the post of Assistant Engineer (Mechanical or Electrical).

(2) Sub-rule (1) shall remain in force until the expiry of a period of two years from the date of this notification.

PART – IV
Regularization of Certain Appointments

10. Notwithstanding anything contained in these rules, any person recruited to the Engineering Services (Mechanical & Electrical) under the Irrigation & Waterways Department, Government of West Bengal, between the 1st April, 1984 and the date of notification of these rules shall be deemed to have been duly recruited under these rules.
