    I am an asst. teacher. i applied for mutual transfer with another asst. teacher jointly on 2nd april ’12 at west bengal central school service commission. but now due to some unavoidable reasons it impossible for me to take the transfer. the date of hearing is 18th may ’12. is there any procedure to avoid the transfer? please help me. otherwise i have to commit suicide. you may also call me. my no. is 9564723023

    : I think at first you should disclose the matter to your partner and write a letter to the Chairman of S.S.C. through proper channel. Actually this kind of matters are very unusual and I also think that the approval cant be made if one of the teachers becomes disagreed at the time of hearing.

    I already disclosed the fact to my partner. i wrote a letter to the secretary of wb central ssc . i also have the received copy of it dated 30th april. but it was written by myself not through school. now tell me what should i do? what if i disagree but my partner wants to take the transfer?

    It is really unusual,there is no provision for cancellation of application for Mutual Transfer in the law. However you may also write to the HM, Secretary of your school with a copy to Chairman to the CSSC. If your school remained absent in response after consideration of your application and want to retain you t your school, and subsequently inform the Chairman CSSC in writing the process may not be accepted by the CSSC. If that does not work attend the hearing and put your objection and request them. So far as my knowledge goes, in your absence from the hearing, the CSSC will not take any decision in this regard. But it may bring lot of tension to you on 18th May whole day. My suggestion is to attend the hearing with the representation from school authority will serve better. I presume. It is entirely based on working knowledge. As there is nothing in the law. You may call me now or at any emergency.

    @Toton_mukh1 : Who the hell are you to be thinking of taking your life by committing suicide? Do you live only for yourselves or for your family/near and dear ones as well? Throw the question of suicide out of your system and I believe, you will be able to arrive at a rational conclusion leading to the solution of your problem. As the term specifies ‘Mutual Transfer’ stands for transfer between 2 individuals based on mutual consent. Even though, your case has been approved by the MC of your institution, I believe you can refuse your inclusion in a process, if you feel so. My advice to you would be to have a talk to your headmaster and your MC and explain the situation to them. Rule 7 of the Mutual Tranfer rules states :
    “The Hearing Committee shall scrutinize the applications for mutual transfer and shall call the respective incumbents and the Secretary or the Head Master/ Head Mistress/Teacher-in-charge, as the case may be, of the concerned schools and the respective District Inspectors of Schools (Secondary Education) or the authorized representatives of the District Inspectors of Schools (Secondary Education) on the date of hearing. After hearing, the Hearing Committee shall prepare a gist, in writing, of the hearing of each application for mutual transfer and shall obtain full signature thereon of all of the persons mentioned above and shall submit a report in respect of each application separately by seven days from the date of hearing to the Central Commission.”
    At any stage, if you refuse to accept the transfer in the hearing and/or refuse to sign on the form of consent, the procedure will not go forward. I would also advise you to have a word with the individual with whom you had decided to have the mutual transfer and convince him/her about your situation so that he/she may also refuse the transfer offer in the hearing. And last, but not the least, why don’t you go and have a talk with your DI. That way, you can save a lot of people (like your HM, Secretary as well as the DI or his/her representative)from being faced with an embarrassing situation.
    Lastly, PLEASE, PLEASE let go of your negativity and think positively and rationally. I would also advise you not to post your contact number in an open forum like this. It could lead to lot of trouble, if someone decides to harm you. This is for your own safety and is advised in most fora).     @shantanil: Why this? Who is going to commit suicide? As per his post he is too fickle minded to keep his word on this account too!

    On the other hand, let us think the heartburn of the counterpart of Toton_mukh1 (here referred as partner). It is actually very hard to find a suitable candidate for mutual transfer. And when he found one who was equally agreeable to the proposal, convinced his HM and MC to put their hands on the application, spent some Rs.1000 and odds as application money, took pain to personally go to central SSC office to submit the form and when he got the date of hearing he suffers the ultimate setback from his ‘PARTNER’.
    It is really funny that a mature man who also went through the above mentioned elaborate process and submitted the form with full knowledge of everything suddenly wants to take a 180 degree turn within 1and half month of his decision.
