Suppose a lady teacher applied (Application date 1st APR) for maternity leave from 1st MAY (9 month pregnancy). Let she gives birth a premature child on 20th April (8 month and some days). Will she eligible for maternity leave? Our H.M. told that she would not be eligible for any maternity leave as she gave birth child before stipulated application date for taking leave. Our H.M. showed the rule from H.M. manual. But how ridiculous it is. If miscarriage leave is granted for 6 weeks but why not for premature delivery. Will she get any maternity leave?

Not quiet satisfactory. Is there any rule to apply for maternity leave 1 month in advance? If premature child birth in that 1 month time. From when leave will be sanctioned? Please clarify with supporting G.O.
