Dear Mr. Bhunia,
I repeat that there is NO question of grant of ENTRY LEVEL PAY to the teacher in any of the cases as he is NOT a fresh recruit in another school despite his SUBSEQUENT appointment by fresh selection by SSC. This is NOT his appointment FOR THE FIRST TIME in a school through SSC. He is NOT A NEW ENTRANT in school service. He is basically a DIRECT RECRUIT in another school through another SSC exam., with ALL THE BENEFITS OF PAST SERVICE. Entry level pay is allowed to an incumbent who joins a service for the first time in his life with NO benefits of past service.

Now,
Case 1: Since he has joined the new school before 01.01.2006 (date of effectiveness of ROPA 2009) he is REQUIRED to communicate his OPTION in terms of Rule 5 whether he wishes to continue to draw pay in pre-revised scale under ROPA, 1998 or wants to get pay fixed in revised structure (PB & GP) under ROPA,2009. If he prefers to draw pay under ROPA, 2009 his pay shall be fixed in revised pay structure under ROPA, 2009 with effect from 01.01.2006 with reference to the LAST PAY drawn by him on 31.12.2005.
Case 2: Since he has changed the school with entitlement to past service benefits sometime between 01.01.2006 and 27.02.2009, the only DISADVANTAGE is that he is NOT eligible to exercise option. This is the difference with Case 1. His pay shall always be fixed in revised structure under ROPA, 2009 with effect from 01.01.2006 with reference to the LAST PAY drawn by him on 31.12.2005.
Case 3: Since he has changed the school after 27.02.2009 (date of Notification of ROPA, 2009) he was in service in the first school on 27.02.2009. He is assumed to have joined the first school before 01.01.2006 through SSC exam. for the first time. Therefore, his pay will be fixed in a manner same as that stated in Case 1.
Your case is a simple one. Why are you still confused especially when you have got favourable feedback from many other experienced persons like Ex-DSE, A.I., HMs etc.!
