Two Types of Bituminous Overlay as Surfacing

NOTIFICATION

In continuation of the Notification No: 5784-PW/L&A/2M-175/2027; dated 12.09.2017, the Governor is pleased to allow two types bituminous overlay with modified guideline which was under active consideration by the department where the road after surfacing work could be maintained by the agency for a period of 3 years of Defect Liability Period (DLP).

Consequently, upon careful consideration, the Governor has been pleased to allow 40mm bituminous overlay as surfacing

Type-I:

Laying 40 mm thick bituminous layer subject to –

(a) The stretches of the road to be chosen in such a manner that the proposed bituminous layer of 40mm is compatible with the present road condition.

(b) By applying proposed bituminous overlay, the stability of the existing layers such as Base course, Sub- base course and Subgrade etc. remains intact.

c) The selection of 40 mm Bituminous layer should not be open graded.

d) The Defect Liability Period (i.e DLP) will be 3 years.

e) The terms and conditions regarding DLP herein shall be the integral part of the contract as notified vide 5784-PW/L&A/2M-175/2027 dated 12.09.2017.

Type-II:

Laying 40mm thick bituminous layer in stages with Pre-mix Carpet (PC) and Seal Coat (SC)

(i) Laying of one-layer 20mm PC with Seal Coat is to be considered after mending potholes/ depressions/ levelling courses (if any). The road is to be maintained by the contractor till end of DLP. Dedicated BOQ items for this 1st layer 20 mm PC and SC are to be considered in the Bill of Quantity (BOQ). (Say, time required to complete this 1st layer with all other ancillary works considered in the estimate as t1).

(ii) The second layer of 20 mm PC with Seal Coat will be executed after 1.50 yrs from the date of completion of 1st layer (including ancillary works if any) of 20mm Premix carpet PC & SC under the written instruction of the Engineer-in-Charge. Mending up of potholes/ depressions/ levelling courses, if formed in the meantime are to be repaired by the contractor at his own cost before laying the 2nd layer of 20 mm PC & SC. Separate dedicated BOQ items for this 2nd layer 20mm PC and SC are to be considered in the BOQ (Say, time required to complete this 2nd layer estimate as t2).

(iii) DLP of the above works will be 1.50 yrs from the date of completion of second layer of 20 mm PC & SC .

(iv) The road under question shall have under the responsibility of contractor for period of (t1+t2+3) years.

(v) Scheduled Time of completion of this type of surfacing work is to be evaluated accordingly. (Schedule time of completion will be (t1+1.5+t2) years.

(vi) The terms and conditions regarding DLP herein shall be integral part of the contract as notified vide 5784-PW/L&A/2M-175/2027 dated 12.09.2017.

Refund of security deposit:

For, Type-I:

(i) 30% of the security deposit will be refunded to the contractor on expiry of 2 (two) years from actual date of completion.

(ii) The 70% of the security deposit will be refunded to the contractor on expiry of 3 (Three) years from the actual date of completion.

For, Type-II:

(i) 30% of the security deposit will be refunded to the contractor after 6 (Six) months from the actual date of completion of the 2nd layer.

(ii) The balance 70% of the security deposit will be refunded to the contractor after 1.5 years from the actual date of completion of the 2nd layer.

All Tender inviting authority shall ensure to keep suitable provision in the e-NIT accordingly.

This order is issued with the concurrence of the Finance Department vide their UO No-Group T/2025-2026/0745 dated 25.09.2025.

This order will take immediate effect.
