NOTIFICATION
In exercise of the power conferred by section 180 read with sub-section (2) of section 126 and subsection (1) of section 127 of the Electricity Act, 2003 (36 of 2003) (hereinafter referred to as the Act) the Governor is pleased hereby to make the following rules:
Rules
1. Short title and commencement:
(1) These rules may be called the West Bengal Electricity (Manner of Service of Order of Provisional Assessment and Appellate Authority) Rules, 2003.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Manner of service of order of provisional assessment:
The order of provisional assessment made under sub-section (1) of section 126 of the Act shall be served upon the person in occupation or possession or charge of the place or premises by registered post with acknowledgement due or by courier service or specific messenger. In the event the order can not be served through any of the above processes, the order shall be published at least in two leading daily newspapers in Kolkata in English and Bengali.
3. Appellate Authority:
The appellate authority referred to in the sub-section (1) of section 127 of the Act shall be such officer of a distribution licensees as may be notified by the State Government.
