NOTIFICATION

In exercise of powers conferred by clause (c) of sub-section (2) of section 180 read with sub-section (2) of section 68 of the Electricity Act, 2003 (Act No. 36 of 2003), the Governor is pleased hereby to make the following rules for prior approval of overhead lines, namely:

1. Short Tile and Commencement

(1) These rules may be called the West Bengal Electricity (Prior Approval for Installation of Overhead Lines) Rules, 2007.

(2) They shall come into force from the date of publication in the Official Gazette.

2. Definition

(1) In these rules, unless the Context otherwise requires-

(a) “Act” means The Electricity Act, 2003 (36 of 2003).

(b) “Government” means the Government of West Bengal.

(c) “Overhead Line” means “overhead line” as defined in the Act.

(2) Words and expressions used in these rules and not defined shall have the meanings as assigned to them in the Act.

3. Inapplicability of provisions of sub-section (1) of section 68 of the Act

The provisions relating to prior approval by the Government for installation of overhead lines as per provisions of sub-section (1) of section 68 of the Act shall not apply to the following-

(a) West Bengal State Electricity Transmission Company Limited (WBSETC Ltd.).

(b) West Bengal State Electricity Distribution Company Limited (WBSEDC Ltd.).

(c) Durgapur Projects Limited (DPL).

(d) The West Bengal Power Development Corporation Limited (WBPDCL),

(e) CESC Limited.

(f) DPSC Limited.

(g) Haldia Energy Ltd. (HEL)

Provided that organisations mentioned in (b), (c), (d), (e), (f) and (g) would inform the West Bengal State Electricity Transmission Company Limited before installation of such overhead lines carrying voltages above 11 KV and such installation shall have to be shifted/ modified to the satisfaction of WBSETC Ltd., in case of any objection/ reservation made by the West Bengal State Electricity Transmission Company Limited.

Provided further that in case the West Bengal State Electricity Transmission Company Limited does not react to a Licensee’s Work Plan within 30 (thirty) days from the date of informing the same with relevant documents, the licensee may presume that the West Bengal State Electricity Transmission Company Limited has no objection to licensee’s carrying out the work as per the submitted plan.
