NOTIFICATION

In exercise of the power conferred by clause (d) of sub-section (2) of section 20 of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997 (West Ben. Act XXV of 1997), the Governor is pleased hereby to make the following rules, namely:-

Rules

1. Short title and Commencement

(1) These rules may be called the West Bengal Land Reforms and Tenancy Tribunal (Recruitment) Rules, 2004.
(2) They shall come into force on the date of its publication in the Official Gazette.

2. Definitions

(1) In these rules, unless there is anything repugnant in the subject or the context,-

(a) “Act” means the West Bengal Land Reforms and Tenancy Tribunal Act, 1997;
(b) “Chairperson” means the Chairperson of the Direct Recruitment Committee;
(c)  “Direct Recruitment Committee” means a committee formed under rule 5 of these rules;
(d) “Member” means a member of the Direct Recruitment Committee;
(e) “Registrar” means the Registrar of the Tribunal.

(2) Words and expressions used and not defined in these rules but defined in the Act, shall have the same meanings as respectively assigned to them in the Act.

3. Appointing authority

The appointing authority, in relation to the posts of the Tribunal required to be filled up by direct recruitment under these rules, shall be the Registrar.

4. Method of recruitment, qualifications and age for direct recruitment

The method of recruitment, the qualifications and age for direct recruitment to the various posts of the Tribunal, shall be as detailed below:-

by deputation from the officers of the West Bengal Higher Judicial Service.
(2) (a) Name of post

Deputy Registrar
by deputation from the officers of the West Bengal Civil Service (Executive).
(3) (a) Name of post
(b) method of recruitment
Court Officer
by deputation from the posts of Schedule A Stenographer of General Pool of the Finance Department, Government of West Bengal.
(4) (a) Name of post
(b) method of recruitment
Personal Assistant to Chairman/Member
by deputation from the posts of Schedule A Stenographer of General Pool of the Finance Department, Government of West Bengal.
(5) (a) Name of post
(b) method of recruitment
(c) qualifications for direct recruitment
(d) age for direct recruitment
Librarian
by direct recruitment
(i) must have a Bachelor’s degree in Library Science from a recognised University, or
(ii) must have a Bachelor’s degree from a recognised University and a Diploma in Library Science from a recognised Institute or University,
not less than 18 years and not more than 32 years on the 1st day of January of the year of advertisement.
(6) (a) Name of post

Stenographer
by deputation from the posts of Schedule B Stenographer of the General Pool of the Finance Department. Government of West Bengal.
(7) (a) Name of post

(c) qualifications for direct recruitment
(d) age for direct recruitment
Cashier
by direct recruitment
must have passed Madhyamik or its equivalent examination,
not less than 18 years and not more than 32 years on the 1st day of January of the year of advertisement.
Note:- A candidate selected for appointment as cashier shall be required to furnish security deposit/fidelity bond as per existing rules.
(8) (a) Name of post

Assistant Librarian
by direct recruitment
(i) must have passed Madhyamik or its equivalent examination.
(ii) must have one year experience in Library work in a reputed Library,
not less than 18 years and not more than 32 years on the 1st day of January of the year of advertisement.
(9) (a) Name of post
(b) method of recruitment
Record Supplier
(i) by promotion from the post of Duftry or Orderly or Peon of the West Bengal Land Reforms and Tenancy Tribunal, or
(ii) by deputation, in the event of non-availability of staff eligible for promotion in the Tribunal, from the post of record supplier of the Land and Land Reforms Department, Government of West Bengal.Note:- The candidates to be recruited to the above post shall have working knowledge of English.
(10) (a) Name of post
(b) method of recruitment
Duftry
(i) by promotion from the post of Orderly or Peon of the West Bengal Land Reforms and Tenancy Tribunal, or
(ii) by deputation, in the event of non-availability of staff eligible for promotion in the Tribunal from the post of Duftry or Orderly or Peon of the Land and Land Reforms Department, Government of West Bengal.
(11) (a) Name of post

Night Guard
by direct recruitment
(i) must be able to read and write Bengali or Nepali,
(ii) must not be suffering from any kind of mental or physical disability or infirmity,
not less than 18 years and not more than 37 years.
(12) (a) Name of post

(d) age for direct recruitment
Orderly/Peon/Sweeper
by direct recruitment
must be able to read and write Bengali or Nepali, not less than 18 years and not more than 37 years.

5. Direct Recruitment Committee

(1) The Direct Recruitment Committee, shall consist of following members:-

(a) the Land Reforms Commissioner and Principal Secretary to the Government of West Bengal. Land and Land Reforms Department, or the Joint Secretary, Land and Land Reforms Department, authorised by such Land Reforms Commissioner and Principal Secretary, as Chairperson;
(b) the Deputy Secretary, Land and Land Reforms Department, as Member;
(c) the Registrar of the Tribunal, as Member.

(2) The Direct Recruitment Committee shall select the candidates for recommending their appointment to the posts to be filled up by direct recruitment under these rules.
