NOTIFICATION

In exercise of the power conferred by clause (3) of article 166 of the Constitution of India, the Governor is pleased hereby to make the following amendments in the West Bengal Rules of Business, as subsequently amended (hereinafter referred to as the said rules):-

Amendments

In the First Schedule to the said rules,-

(2) under the heading “Departments”, omit item and entry “LXIV. Department of Sericulture”;

(3) under the heading “Allocation of business among the departments”, under the sub-heading “XIX. Department of Micro, Small and Medium Enterprises and Textiles”,-

(b) in Part I, after item No. 3, and the entries relating thereto, insert the following item and entries:-

“3A. Promotion and regulation of Plantation of Silkworm food plants, Rearing of Silkworm, Production of Silkworm eggs, Silk cocoons, Silk Yarns, production and processing of all types of Silk yarn and Silk fabric”;

(d) in Part II,–

(i) for item No. 3 and the entries relating thereto, substitute the following item and entries:-

“3. Trade and commerce within the State, so far as they concern micro, small and medium enterprises and textiles including sericulture subject to the provisions of entry of List III (entry 26 of List II)”;

(ii) for item No. 4 and the entries relating thereto, substitute the following item and entries:-

“4. Production, supply and distribution of products of micro, small and medium enterprises and textiles including sericulture subject to the provisions of entry of List III (entry 27 of List II)”;

(iii) for item No. 8 and the entries relating thereto, substitute the following item and entries:-

“8. Micro, small and medium enterprises and textiles including sericulture subject to the provisions of entries 7 and 52 of List I (entry 24 of List II)”;

(iv) for item No. 9 and the entries relating thereto, substitute the following item and entries:-

“9. Trade and commerce in, and the production, supply and distribution of, the products of micro, small and medium enterprise and textiles including sericulture where the control of such industries by the Union is declared by or under law made by Parliament to be expedient in the public interest, so far as this department is concerned (entry 33 of List III)”;

(v) for item No. 10 and the entries relating thereto, substitute the following item and entries:-

“10. Economic planning so far as micro, small and medium enterprises and textiles including sericulture are concerned (entry 20 of List III)”-,

(e) in Part III,-

(i) for item No. 4 and the entries relating thereto, substitute the following item and entries:-

“4. Patents, inventions and designs; copyright; trademarks and merchandise marks, so far as the products of micro, small and medium enterprises and textiles including sericulture are concerned (entry 49 of List I)”;

(ii) for item No. 8 and the entries relating thereto, substitute the following item and entries:-

“8. Establishment of standards of quality of goods and products of micro, small and medium enterprises and textiles, silkworm food plants, silkworm eggs, silk cocoons, silk yarns and silk fabrics to be exported out of India or transported from one State to another (entry 51 of List I)”;

(iii) for item No. 9 and the entries relating thereto, substitute the following item and entries:-

“9. Inter-State trade and commerce so far as products of micro, small and medium enterprises and textiles including sericulture are concerned (entry 42 of List I)”;

(iv) for item No. 10, and the entries relating thereto, substitute the following item and entries:-

“10. Trade and commerce with foreign countries and import and export so far as products of micro, small and medium enterprises and textiles including sericulture are concerned (entry 41 of List I)”;

(v) for item No. 12 and the entries relating thereto, substitute the following item and entries:-

“12. Micro, small and medium enterprises and textiles including sericulture the control of which by the Union is declared by or under law made by Parliament to be expedient in the public interest (entry 52 of List 1)”;

(vi) for item No. 13 and the entries relating thereto, substitute the following item and entries:-

“13. Micro, small and medium enterprises and textiles including sericulture declared by or under law made by Parliament to be necessary for the purpose of defence or for the prosecution of war (entry 7 of List I)”.
