NOTIFICATION
In exercise of the power conferred by section 17, read with sub section (1) and sub-section (2) of section 10B, of the West Bengal School Service Commission Act, 1997 (West Ben. Act IV of 1997), the Governor is pleased hereby to make the following amendments in the West Bengal School Service Commission (General Transfer, Transfer on Special Grounds and Reallocation) Rules, 2015, published under this Department Notification No. 159-SE/S/1S-4/95(Part), dated 27th February, 2015, as subsequently amended, (hereinafter referred as the said rules):-
Amendment
In the said rules,-
(1) in rule 3, after sub rule (2), insert the following sub-rule:-
“(2A) Although the online application for the transfer in the designated portal is allowed under rule 4, however applications under clause (e) of rule 4 shall be considered twice in an academic year i.e. summer and winter vacation of school, as the case may be, so that academic interest of the students are not hampered:
Provided that in case of transfer application made on medical grounds and other grounds referred to in clauses (a) to (d) of rule 4 may be considered without any restriction.”;
(2) to rule 4, add the following proviso:-
“Provided that in case of special circumstances for reasons to be recorded in writing, the operation of online application may be suspended for such time as may be specified, by notification.”;
(3) to sub-rule (6) of rule 5, add the following proviso:-
“Provided that an application for general transfer shall not be entertained by the concerned School Authority, if Pupil Teacher Ratio (PTR) of the school falls deficient as per the norms laid down in the Right of Children To Free and Compulsory Education Act, 2009 and other Government orders for the time being in force on account of proposed transfer:
Provided further that the issue of the Pupil Teacher Ratio may be relaxed in case of transfer application made on medical grounds and other grounds referred to in clauses (a) to (d) of rule 4.”;
(4) for clause (b) of sub-rule (3) of rule 6, substitute the following clause:-
“(b) take views, through portal, of the Chief Medical Officer of Health (CMOH) or his authorised Medical Officer in case of Districts and in case of Kolkata, the Medical Superintendent cum Vice Principal of Medical College and Hospital, Kolkata or his authorised Doctor, regarding the transfer applications made on medical grounds with a report from the doctor of School Managing Committee.”.
