MEMORANDUM
Whereas, in terms of Rule 104A of the WBS (DCRB), Rules, 1971, the son or daughter of a deceased Government Employee/ Pensioner is suffering from any disorder or disability of mind or is physically crippled or disabled so as to render him or her unable to earn a living even after attaining certain age (which is at present 25 years), the family Pension shall be payable to such son or daughter for life subject to certain conditions stated therein;
And,
Whereas, the family pension is payable to the eligible physically handicapped/ mentally crippled child of a deceased Government employee/ Pensioner in preference to unmarried/ widow/ divorced daughter and the such unmarried/ widow/ divorced daughter becomes eligible for family pension only if there is no such physically handicapped/ mentally crippled child, as clarified in Memo. No. 432-F(Pen) dated 02.07.2008;
And,
Whereas, in terms of No. 50-EDN(CS) Dated 25/01/2024, the benefit of family Pension in respect of unmarried/ widow/ divorced daughters beyond the age of 25 years has been extended to the deceased employee (teaching or non-teaching) of Government-aided Colleges under (Death-cum-Retirement Benefit) Scheme issued vide No. 1097-Edn (CS) dated 31.05.1978, and the West Bengal Non-Government College Employees and Day Students’ Home Employees (Death-cum-Retirement Benefit) Scheme issued vide No. 1955-Edn (CS) dated 23.12.1981;
And,
Whereas, at present, there is no provision of family pension to the son or daughter of a deceased employee (teaching or non-teaching) of Government-aided Colleges, who is suffering from any disorder or disability of mind or is physically crippled or disabled so as to render him or her unable to earn a living even after attaining the age of 25 years;
Therefore, in line with the provisions under Rule 104 A of the West Bengal Services (Death-cum-Retirement Benefit) Rules, 1971, if the son or daughter of a deceased employee (teaching or non- teaching) of Government-aided Colleges, falling under the purview of the DCRB Schemes as stated in Para-3, is suffering from any disorder or disability of mind or is physically crippled or disabled so as to render him or her unable to earn a living even after attaining the age of 25 years, the family Pension shall be payable to such son or daughter for life subject to fulfillment of certain conditions as stated in the afore-mentioned Rule.
This order issues with the concurrence of the Finance Department vide their U.O No Pension/2025-2026/0324 Dated 05.12.2025.
This order shall take immediate effect.
