Registration of New Vehicles only after Installation of Tracking Device

NOTIFICATION
Whereas, in the sub-rule (5) of rule 90 of the Central Motor Vehicles Rules, 1989, as amended (hereinafter referred to as said Rules), it is stated that all the national permit vehicles shall be fitted with a vehicle tracking system device as per AIS 140; and
Whereas, in the rule 125-H of the said Rules, it is stated that all public service vehicles, as defined under clause (35) of section 2 of the Motor Vehicles Act, 1988, as amended, shall be equipped with or fitted with vehicle location tracking device and one or more emergency buttons except in (i) two-wheelers; (ii) E-rickshaw; and (iii) three-wheelers; the specifications, testing, and certification of the vehicle location tracking device and emergency button shall be in accordance with AIS-140:2016, as amended from time to time, till such time the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986; and
Whereas, in clause (v) of sub-rule (1) of rule 129 of the said Rules, it is stated that every vehicle of category N2 and N3 shall be fitted with a vehicle tracking system device as per AIS 140; and
Whereas, notification No. 4267-WT dated 14.11.2022 read with notification No. 4530-WT dated 30.11.2022 of this Department provides scope of new registration and issue of a conditional certificate of fitness subject to submission of declaration as prescribed therein.
Now, therefore, after careful consideration of the above mentioned Rules and notifications in relation to vehicle tracking system devices and emergency buttons, the Governor is pleased hereby to partially modify the above-mentioned two notifications dated 14.11.2022 and dated 30.11.2022 –
That in case of new registration, the registering authorities shall register all such new vehicles as specified in the all above-mentioned said Rules, only after ensuring that the appropriate vehicle location tracking device has been attached in the appropriate manner in such vehicle; and only in case of issue of a certificate of fitness, conditional certificate of fitness shall be issued following the procedure as mentioned in notification No. 4530-WT dated 30.11.2022 of this Department upto the date mentioned therein.
This notification will take immediate effect.
