    I am sharing a sample report by the enquiry committee for appointment in compassionate ground. Any modification for betterment will highly be appreciated.
    OBSERVATIONS OF THE ENQUIRY COMMITTEE
    1. (Name of the Spouse) wife of Late (Name of the Employee), Ex-(Designation) has received following:
    (i) Death Gratuity Rs. 4,00,000.00
    (ii) Group Insurance Rs. 16,000.00
    (iii) Encashment of Leave Rs. 1,40,000.00
    (iv) G.P.F. Balance Rs. 20,000.00
    (v) Arrear of ROPA 2009 Rs. 20,000.00
    2. From local enquiry it is found that (Name of the Spouse) wife of Late (Name of the Employee), Ex- (designation) do not have any landed property.
    3. From local enquiry it is found that (Name of the Spouse) wife of Late (Name of the Employee), Ex- (designation) has no other source of income except family pension of herself.
    4. (Name of son) is the only son of Late (Name of the Employee), is a married person and leaving separately and there is no objection in favour of his mother (Name of spouse) for employment.
    5. No objection from other family member as per law is verified, an affidavit verified in presence of First Class Judicial Magistrate is also enclosed.
    In view of the above and from circumstantial evidence and local enquiries the statement furnished by the applicant in Part – I and Part – II of the Proforma seems to be correct.
    So, the committee recommends that the prayer of (Name of the spouse) may be considered for appointment to the post applied for.

    What will be the enquiry report if it transpires that the deceased employee had married for the second time in the life time of the first wife and the 2nd wife has a child also? The1st wife is living in village and the second one in town or near the place of the last posting of the deceased. When 2 claims were made in respect of financial benefits then his office came to know about the fact of two marriages. Please advise.

    Primarily, the legal wife as per record in service book (1st wife) is to considered for the financial benefits. Enquiry committee / Office may ignore the claim of 2nd wife.
    However, you can say better whether the second wife having a child, also acquire legal right or not.

    So far my knowledge goes the second wife as per Supreme Court’s ruling is not entitled to claim any relief because marrying in life time of the first wife by a Government servant without divorcing the 1st wife is a misconduct. But the off springs born out of this relation are legitimate heirs and they can not be overlooked. Marriage can be irregular under service rules but not void. Compensation or job for the second wife would,in such cases would be illegal but children if eligible can not be deprived.
