These writ petitions were being heard along with W.P. 27619 (W) of
2014. However, since the petitioners in W.P. 27619 (W) of 2014 have
expressed disinclination to proceed further with such writ petition, by a
separate order passed thereon I have directed de-tagging of all these
three writ petitions. 2
Since common questions of law and fact are involved, these three
writ petitions shall be heard together.
I have heard Mr. Majumder, learned Government Pleader appearing
for the State, who has concluded his argument.
Mr. Gupta, learned senior advocate for the Howrah District Primary
School Council has commenced his argument. Due to paucity of time,
he could not conclude today.
It is recorded that although the petitioners in W.P. 27619 (W) of
2014 (wherein the said Council is a respondent) may withdraw the same,
Mr. Gupta shall conclude his argument since certain important
questions of law are involved in all the writ petitions.
Put up these writ petitions on Wednesday next (03.12.2014).
Let appropriate advertisements be published by the respective writ
petitioners in ‘The Statesman’ and ‘Bartaman’/’Aajkal’ by Saturday next
notifying institution of all these writ petitions together with a gist of the
subject matter of challenge and indicating therein that this Court desires
interested parties, who might be affected by reason of any order being
passed on these writ petitions in favour of the petitioners, to contest the
same on the next date either appearing personally or through learned
advocate(s).
Let copies of this order duly counter-signed by the Assistant Court
Officer, be retained with the records of W.P. 29607 (W) of 2014 and W.P.
30510 (W) of 2014.
