Can any Teacher get 6 C.L for absent in a week from Monday to Sat’day
November 17, 2012 at 2:29 pm #75361AnonymousInactiveNo. of C.L could not be exceeded 7 days including Sunday & Holiday, in this case total no. of holidays including sundays is 8. so, acc. to me he/she does not get C.L
ok, lets wait for other opinion.November 17, 2012 at 3:20 pm #75362AnonymousInactiveDear friend,
Yes, a teacher can take 6 C.L.at a time but it will not Monday to Saturday or Monday to Monday. He can start other than Monday.
An Example:-
C.L. Tuesday to Monday = 7- Sunday= 6 C.L. (it is not more than total 7 days absent.)
But in case of Monday to Saturday = 6 + 2 Sunday( Starting & Finishing) = 8 ( it is more than 7 days)
Am I clear Friend ? Take care, with regards.November 17, 2012 at 3:46 pm #75367AnonymousInactiveFriend,
Please refer to Leave Rule :GO no 1541-EDN(S) dt.15.12.77
“Casual Leave :
Casual Leave shall not be treated as absence from duty and there shall consequently , be no interference with rate of emolument of the teacher or the non teaching employee concerned.
A teacher or a non teaching employee of the school may have 14 days of casual leave in a calender year.
The Casual Leave may be affixed or prefixed to any holiday or Sunday but the total period including the holiday or Sunday shall not exceed 7 days at a time. Sundays and holidays falling within the period of Casual Leave shall not be counted as a part of the Casual Leave.
Provided Casual Leave shall not be affixed or prefixed to any long vacation.”
So, if we count from Monday to Saturday, the total no. shall be 6. Sunday will not be counted.
Hence, ONE CAN GET 6 CLs IN A WEEK FROM MONDAY TO SATURDAY.November 17, 2012 at 5:18 pm #75370AnonymousInactiveFriends,
The most important part of CL rule, which has application in the present case, is “The Casual Leave may be affixed or prefixed to any holiday or Sunday but the total period including the holiday or Sunday shall not exceed 7 days at a time. Sundays and holidays falling within the period of Casual Leave shall not be counted as a part of the Casual Leave.”
Now, when a 6-day long CL period extends from Monday to Saturday, it is suffixed to previous Sunday and prefixed to the next Sunday. In such a situation the clause “the total period including the holiday or Sunday shall not exceed 7 days at a time” creates an embargo to availing of 6 days CL for the period Mon. – Sat. because the total period including two Sundays becomes 8 days, exceeding the limitation of 7 days. So, CL for a continuous spell of 6 days counted from Monday to Saturday in a week is not permissible under rule.
However, a 6-day CL period from Tuesday to Monday is allowable provided it is not prefixed or suffixed by holidays.
The following combinations are not permissible under rules:
Sunday, Monday – Saturday (6 CLs), Sunday – NOT allowable as total period of absence is of 8 days.
Sunday, Monday (HOLIDAY), Tuesday – Saturday (5 CLs), Sunday – NOT allowable as total period of absence is of 8 days .
Saturday (HOLIDAY), Sunday, Monday – Saturday (6 CLs), Sunday – NOT allowable as it is absence of 9 days.
Sunday, Monday (Working day), Tuesday – Saturday (5 CLs), Sunday, Monday (CL), Tuesday (HOLIDAY) – NOT allowable as it is absence of 8 days.
etc. etc.
Therefore, the period of CONTINUOUS ABSENCE including the CLs should never be more than 7 days.
Thanks.November 17, 2012 at 5:21 pm #75372AnonymousInactiveI support donyio_polo in this regard. 6 days CL is not allowed.
