Will some body tell me that whether the Confirmation Letter is essential for a Teacher of Govt.Aided High School or not? Our H M is telling that he or Secretary will not issue the confirmation Letter. But as far my belief and knowledge on law it is clear to me that issuing of Confirmation Letter is a mandatory work. If someone help me with Govt. Order then I will be highly oblized to him.

If the authority fails to do so, it is assumed that there is nothing adverse against the employee and the employee is assumed as confirmed.

If a teacher has been serving in a school against a permanent vacancy continuously for more than two years and no specific decision has been taken by the Managing Committee regarding his confirmation or otherwise in a meeting held within a month of completion of the period of probation, such teacher shall be considered to be a confirmed teacher.

A lot of thanks sir.September 29, 2012 at 4:36 pm #74568AnonymousInactiveI am an assistant teacher and joined my school on 04.01.2001. when I joined the school it was just upgraded as an high school from an junior high for a period of 01.05.2000 to 30.04.2003. For this reason three posts were created. My name was recommended by the secretary, SSC, as an AT in normal vacancy. I was appointed by the sectretary of my school as an AT, but it was not metioned whether it was permanent or temporary or normal or additional vacancy. But in my approval it was mentioned that the nature of vacancy is temporary and approved for the period 04.01.2001 to 30.04.2003. Again in 2003 at the time of staff approval like other teachers I was approved by D.I. in normal vacancy for a period from 01.05.2003 to 30.04.2006. Again I was approved by D.I. in staff aproval as an at in normal vacancy. Except the first approval I got no approval personally as an AT in permanent vacancy till now. What I have to do? How can I get my permanent approval? Which will be the confirmation date of my job. Please help me.
Thanks to all.September 29, 2012 at 5:11 pm #74570AnonymousInactiveYou have written that , YOU HAVE GOT NO SECOND COPY OF APPROVAL. Your school is upgraded and due to this reason three (3) new vacancy sanctioned by the DSE. These three vacancy will be NORMAL vacancy.
The up gradation is made provisionally for 3 years. Then it will be regarded as High School to observe the (i) enrollment of the students, (ii) the result of the Madhyamik Pariksha. etc.etc….
There is no scope retention /re approval for a vacancy which is declared as normal vacancy by the DSE. How it can possible the term “staff approval” or “again and again” ? It is possible only for Additional Post. After 2 years the Post applied for RETENTION. With me two more teachers also were appointed, but in their approval in both the cases it was mentioned that the nature of vacancy is permanent. Why in my case it was temporary. Another one question is which will be the date of confirmation of my service?

Your post is a NORMAL vacancy(for up gradation to class X, 12 teachers are required with the H.M. Those 12 vacancy is called normal vacancy) . So, your confirmation will be on 04/01/2003.
