Harasment to get Death certificate

Friends, a person died in an accident. Hospital authority has sent necessary documents to the local Panchayet. But the Panchayet is refusing to give the death certificate with out having the postmortem report. but the family is informed that it takes a long time to get the postmortem report. Thus the family is facing a serious problem in their further proceeding including to claim insurance benefit etc. Is the Panchayet correct to ask for the postmortem report to issue a death certificate?

August 15, 2012 at 2:55 pm #73653AnonymousInactiveYou are true that in unnatural death cases post mortem examination is necessary. But how the body was ceremated or buried when it was a police case? It is a fact that the person has died but if there is any procedural lapse by the police or hospital in releasing the body to the family members without post mortem examination, does that mean the person has not died? The panchayat should issue the death certificate because at the time of cremation or burial, the disposal of dead body must have been recorded in the ceremation or burial register. May be the family may not get the benefit of accidental death in the matter of claims etc.but all other dues would be released without any hinderance. Post mortem examination is done after death to eaxmine the cause of death or to ascertain that how the death occurred but it is done after the death hence the death is undisputed.

But I can’t simply understand why the family cannot get a certificate when death is confirmed in police record, hospital record and postmortem is also done but the report is due. Is it that because “the cause of death ” is not confirmed? Then should there not be a system for provisional death certificate?

And the Government will be taking action which may involve at least 3 to 6 months. Alternatively you can apply for the post mortem report to the respective Chief Medical Officer of Health or ACMOH through the officer in charge of the police station under whose jurisdiction the person had died. The respective officer in charge of the police station will give an NOC on the application under his seal and signature. You take that application to the Health Department officer where the PM examination had been held and produce the no objection certificate before the authorities and you may get a copy of the PM examination after payment of the official fee after few days. There is an another way which is very popular. Contact the DOM of the morgue who had dissected the dead body during the post mortem examination.Be a little bit friendly to him and ask the way to get the post-mortem report. I hope that after greasing his palm, you will hundred percent get the post-mortem report. He will manage the P.M report, but do not ask me as to who will share that money.Mr Roy, corruption is an inseparable part of our system. Now tell me whether you will look the benefit of your house or act like Gandhi ji? You can also seek a copy of the post-mortem report by filing an application under section 6 of the RTI act 2005, but how much time they will take is beyond the imagination because the RTI act is being very loosely implemented in our state. Moreover, as the Chief information Commissioner are the retired high-ranking officers of the Government of West Bengal, they do not bother for the law. An RTI appeal before them remains pending for years together. I am a victim of their callousness and before they could take take up my matter for final hearing, I got the required information with a Xerox copy of the same by greasing the Palm of the peon of a secretary level officer of Writers Buildings. So is the state of affairs and hence who cares? I am sorry to write the actual fact which is faced by an ordinary Indian on this day of August 15,2012.

The corrupt people as well as the system including the policy-maker ashamed today that such kind of practices are running these days. I think your post makes us more aware and in no way encourage to take the short=cut, instead help us to cope with the difficulties. Am I right?

Think of the transportation charges, his meal away from home,his harassments after meeting the new people for his work, the laws tutored to him by the gentlemen like us. What and how much a poor citizen can do? On how many fronts he can fight? I had read a news that an OC of the police station demanded some money from a person in Bihar Samastipur for getting a legal work.The man could not pay him and rather preferred to hang a board around his neck demanding help and alms from the people. It was written that “OC of a certain police station has demanded bribe for getting my legal work and I do not have money to pay so please help me”. Photographs were published in news papers but after that an estrange message we read in the news paper that the work of the person was the conspiracy of the opposition and he has been arrested to defame the Daroga. Now tell me where an ordinary person should go?

Do you know that when an young IAS joins the job he has too many aspirations and dreams to work for the country but the time teaches him that he is nothing without the help of an illeterate or half baked politician so he compromises with the situation as he is a wise man with more IQ. Inspite of the facts that we have our morale, respect in society , self respect in family ,a large extent of honesty,seldom ill will towards any one but even do not flourish whereas a dishonest politician was previously a small para chengra, then became Goonda, then became chamcha of an MLA or Councillor, then became a collector of ill gotten money and after getting required maturity in the field became a Neta such as Councillor or MLA or MP. Our constructive IQ makes us a clerk and his distructive IQ makes him a leader.But even then we do not have to loose the heart because history teaches us that fight against the evil forces is a continuous process which should continue for ever and we all should think of our country and not of politics or political ambitions.
