    MEMORANDUM

    Certain points have been raised in connection with the drawal of House Rent Allowance of State Govt, employees admissible in terms of para 13 of Finance Deptt. Memo No.7309-F dated 16-10-98 of W.B.S. (ROPA) Rules, 1998, the undersigned in directed by order of the Governor to offer the following clarification on the same for inform ation and guidance of all concerned.

    Points Replies
    1. If an employee shares Govt. accommodation allotted rent free to another Govt, employee, how and at what rate the said employee shall draw house rent allowance. No house rent allowance is admissible to him.
    2. Whether an employee residing in accommodation allotted to his/her parents/son/daughter by the State Govt./Central Govt./ an autonomous Public Undertaking or Semi-Govt, organisation such as Municipality Corporation, Port Trust, Nationalised Banks, Life Insurance Corporation of India, etc. will draw house rent allowance as admissible. No House Rent Allowance is admissible to the Govt. employee
    3. If husband/wife of an employee has been allotted accommodation at the same station or nearby by the State Govt. Central Govt. an Autonomous Public Undertakings or Semi-Govt, organisations such as Municipality Corporation, Port Trust etc. whether H.R.A. is admissible to him/her if he/she resides in that accommodations or resides separately in accommodation rented by him/her. No House Rent Allowance is admissible to the Govt. employee.

    Each of them will be governed by the rules of their respective organisations. Eligibility of husband for house rent will be determined in terms of the HRA rules of the state govt. while admissibility of HRA for wife will be determined according to the rules of SBI.

    The ceiling of HRA i.e. Rs. 6000 is applicable for the state govt employee even if the spouse is a central govt or undertaking employee. If the wife is getting HRA @ Rs. 6000 or more, husband will be paid no HRA by the State Govt. Each state govt employee needs to fill up a HRA declaration form twice a year.

    Yes, I agree. That’s why I used the phrase “respective organisations”. In that query made by “amrita” on 31 Aug, husband is a state employee while wife is in SBI. So, if wife gets HRA @ Rs 6000 or more in SBI, husband shall not be eligible for any amount of HRA under state govt. rules because of ceiling.
    Now my query is:
    If husband working in state govt. receives HRA @ Rs 5000, then what is the HRA admissible to wife working in state electricity board (WBSEDCL, WBSETCL, WBPDCL) or in SBI or in any central govt. deptt.???

    central govt employees do not have any ceiling for HRA. They don’t need to declare the amount paid as HRA to their spouse. The state govt employee has to adjust the HRA paid to him/her in accordance with the HRA paid to his/her spouse. A state govt employee can get HRA @ Rs. 5000 in only one condition if the HRA paid to his/her spouse is Rs. 1000 or less.

    Iam teaching in a college, and my HRA was 15% of my Basic (Rs. 2600), my wife works in a private I.T. Company and is drawing an HRA of 4725/ per month. My office has fixed my HRA to 1275/- per month since i have given a declaration regarding my spouse, stating that a working couple can draw at most 6000 per month together as HRA.
    My question is that is it applicable in our case also, since none of us are enjoying any Govt post or accommodation?

    I think, College is also following the same rule, regarding this issue, like Central / State Govt. employees.

    You have filled up the HRA form with a misconception. Since your wife is working in private sector the HRA paid to her should not be taken into account. Get it rectified as soon as possible else you will face various problems in future.
