    Could a lady Para Teacher in Govt. aided schools in West Bengal avail miscarriage leave of 6 weeks ? Is there Govt. order regarding this ? If school authority refused to sanction this leave could a Para Teacher take any legal step against school authority ? Plz reply .

    Acc. to G.O- No. 134-SE(Pry)/55/Ped/PBSSM, dated 26.02.2009
    Maternity Leave:
    135 (One hundred thirty five) days maternity leave may be enjoyed by the lady Para teacher. Such leave may start two months before the date of delivery of the child and may continue after the date of delivery.
    Further this leave period two is not mandatory. According to the convenience of the incumbent maternity leave may be availed. Such maternity leave shall be sanctioned by the School Level Monitoring Committee (SLMC) and Managing Committee for primary and upper primary respectively on production of medical certificate from a registered medical practitioner.

    At present there is no provision of sanctioning maternity leave on miscarriage/abortion for Para Teachers. However, such provision (leave for a period of 6 weeks in case of miscarriage/abortion) is there for state govt. employees as well as lady teachers of school.
    If any legal step is taken demanding such leave for 6 weeks in case of miscarriage/abortion, high court may take decision in favour of the lady para teacher. … I hope.
