One thing I would like to add that when a Deputy Secretary becomes Joint Secretary in usual pay scale under C.A. Scheme, he becomes a designated Joint Secretary and holds a ‘lien’ in the post of Deputy Secretary. And I don’t know why the Government Rules are not made easy to conceive, …………….
Dear Mr. Ray,
Having had a discussion with a Jt. Secy. (WBCS Exe.) I have come to know that the promotional scheme of WBCS officers provides that an officer entering the WBCS Gr-A service with GP 5400 in PB-4A gets first promotion to the post of Asst. Secy. with GP 6600 in PB-4A on completion of 8 years of service and, then to the post of Dy. Secy with GP 7600 in PB-4B (and not PB-4A) with minimum initial band pay of Rs 28000 on completion of another 8 years of service i.e. after 16 years of total service in PB-4A. He earns the next promotion to the post of Jt. Secy. with GP 8700 in PB-4B on completion of a another 4 years of service,subject to the availability of vacancy. That is to say that he has enough scope to become Jt. Secy on completion of a total of 20 years of service counted from the date of entry in to the grade of Gr-A Executive (GP 5400 in PB-4A). Generally, cadre strength is such that one WBCS (Exe.) officer has enough scope to become Jt. Secy. after 20 years of service.
Though it seems that WBCS (Exe) officers get normal promotion on completion of 8 years, 16 years and 20 years of service and, it resembles the normal benefits extendable to an employee under CAS yet these are not at all CAS benefits. Their cases are mentioned in CAS yet it is different from ordinary provisions of CAS. This is the root cause of all confusion. Service of a WBCS officer is called Constituted Service which is different from others. In all likelihood, the prospect of their service is similar to Organised Group-A service under Central Govt., where time-bound promotions takes place from JTS Grade (Gr-A entry grade with GP 5400) to STS Grade (GP 6600) on completion of 4 yrs, then to JAG Grade (GP 7600) after next 5 years, then to SAG Grade (GP 8700) after another 5 years, then to HAG Grade (GP 10000) on completion of total 17 years of service in Gr-A post (starting from JTS Grade). As far as I know, IAS officers reach the HAG Grade with GP 10000 (Jt. Secy. at the Centre) (Equivalent to Spl. Secy. in the State) on completion of 15 years of service instead of 17 years.
I have limitations of knowledge of the service rules of different cadres. I have discussed with others and made an attempt to explain to you.

No, what I put as an example was related to getting the benefit of Scale No. 19 (with the designation of Joint Secretary) under CA Scheme in W.B.S.S. This involves distribution of posts in ratios. It will take some time to elaborate, I will explain it as soon as I am free.

“Notice’ means intimation. An application in white paper.

Hello.. I have a question.I am a state govt employee for 2 years (ie, temporary). I want to join in another post of higher scale of state govt . I did not suppress any fact and I have obtained NOC for joining in new service from my appointing authority. I do not need service continuation. Can I tender resignation and join in new service or whether I have to wait till my resignation accepted by appointing authority and release. PLEASE REPLY

You have very clearly explained the meaning of the term ”Lien”
In Short lien can be taken ( for 2 year and at the most 3 years) by a permanent Govt employee)
I wanted to ask you, whether these rules of lien is applicable to all the Indian states, meaning state Govts?

please see rule 34A of W.B.S.R. Part I. It states –
34A. (1) No Government employee shall, unless the Government otherwise directs, be permitted to resign if he fails to serve on his appointing authority due notice at least for-
(a) in the case of a Government employee holding no lien or suspended lien on a permanent post under the Government,…………..one month ; or
(b) in the case of a Government employee holding lien or suspended lien on a permanent post under the Government, three months.
A Government employee who tenders resignation and quits without giving the notice as provided in sab-rule (1) ‘shall, at the discretion of the appointing authority, be liable to forfeiture of his salary for the period by which the notice falls short of the requirements of Resignation clause (a) or clause (b), as the case may be, of that sub-rule in addition to such disciplinary action as may be taken against him for contravention of these rules11.
A temporary employee may not wait for acceptance of resignation if it crosses the time limit of one month.
