hello,
I’m glad to see the circular. No. 438-SE/S/5P-19/09 Date: 19.05.2014
I sought for the higher qualification i.e. M.Sc. in 2011. I got permission from the then Managing committee to pursue my M.Sc degree from Nalanda open University in Chemistry. But I could not get the same from the DI as per the existing rule.I was appointed in B.Sc pass . I’d obtained honours degree in between my SSC exam and its result in 1999. Now recently I obtained my M.Sc degree. Am I eligible to apply for the higher scale now as per the new circular? please suggest me. If so what should i do now?

I think you did not read the order carefully. Please read it again carefully, specially this portion ….
“The School Education Department, Government of West Bengal, receives a number of cases in connection to the teachers who improved qualification with permission of the Managing Committee but no permission was received from the District Inspector of Schools. Even it is seen that the teachers completed B.Ed. and similar professional courses without receiving any permission from the District Inspector of Schools though involvement of fund is associated with the improvement of qualification or completion of professional courses. Complications are arising while granting higher scale of pay in pursuance with the orders issued in different ROPAs and provisions of the Control of Expenditure Act, 2005. A number of orders have been issued to this effect which are not sufficient to meet up the requirements. yes I did.
When sought permission for getting admission in M.Sc distant mode, school M/C allowed me to do so but D.I showed me the order which stated that teacher appointed in pass graduate can not be given the permission for the higher qualification which may rise the question of higher scale. however I continued with the M.Sc. keeping in view that in future I can apply for the post of headmaster. I completed it but did not claim for the higher scale. but in between I saw this circular published in last month. this showed me a silver lining of hope that I must be eligible as the circular does not state this is for those who are in hons. degree. as long as the up gradation of hons scale to pg is concerned the older orders are suffice.

You need to understand one simple thing. Can a Group D staff claim PG Scale if he attains PG Degree? Similarly, RLST for Assistant Teachers in this state is conducted in two different categories – (i) Pass, (ii)H/PG . You are qualified in Category (i). I have read your posts and the answers given to you. It is true that the order is a bit ambiguous. But as it is issued in contravention of the Control of Expenditure Act ‘2005 and in suppression of all previous order on this issue, you have a reasonable ground to apply for the higher scale of pay that you intend to. Since it does not specifically mention for whom this order is not applicable, it leaves room for you and others like you to have a go. If the concerned authorities do not oblige you, on the strength of this order(provided no further clarification is given on this order by the issuing authority) you can sue them in the court. Sir,I have done M.A from distance education without permission of D.I and M.C .I am working at pass cource.I want to apply for Hons. through WbRLST.will M.A be granted by Wbssc ? -
