Permission for Higher Study – Cancellation of Order No. 438-SE

I am an assistant Teacher.I joined my service on 26.08.2010 as a permanent teacher of Mathematics in H/PG category. But at the time of my joining I was only an Honors Graduate and studying M.Sc (math) in regular mode. Before joining service I had completed two semesters. Two more semesters remained to be completed. I informed this fact to my school authority. The authority (MC) advised me to apply for study leave to the MC.I was further advised that as I joined my service only a few days earlier, I had to apply for Study Leave on Without Pay. Accordingly, I applied for Study Leave on without Pay from 06.09.2010 To 18.07.2011(316 Days) and my prayer was granted by the MC.
Thus, I went to complete M.Sc course. After completion I rejoined my service on 19.07.2011.After that postfacto permission from ADI was accorded. my school authority submitted before WBBSE Kolkata,the relevant documents in favor of sanctioning my Study Leave on Without Pay. After a few months my school received a letter from Asstt. Secretary (General) WBBSE wanting some additional papers on the matter of sanctioning the Leave. The papers mentioned were sent by post and by hand. The Leave is yet to be sanctioned.What should I do?

and apply for higher scale to the secretary of the school through the HOI. MC have to forward the case to the DI/ADI concerned for according higher scale.

Order No. 438-SE/S/5P-19/09 dt. 19.05.2014, the order is hereby cancelled w.e.f. the date of issue of the cancellation order এইভাবে ORDER CANCEL দেখে মনে হয় বিশেষ কাউকে সুবিধা দেবার জন্য করা হয়েছিল। তাহলে যারা দুই অর্ডারের মধ্যবর্তি সময়ে কাজ করে নিল তারা হায়ার scale পাবে ক্যান্সেল হওয়ার পরেও। তাহলে আমি কী অপরাধ করলাম , আমি ও তো জমা দিয়েছি অর্ডার বের হবার পরেই । সেকনে DI অফিসে কাজ পড়েছিল বলে হয় নি তার মাসুল কী আমাকেই দিতে হবে

I had joined service on 19.11.2007 as an honours teacher of English. At the time of joining i had completed my first year of Masters in English under R.B.U. At the time the m.c. in my school had only given me a verbal permission to undergo higher education. However in 2013, when i decided to apply for higher scale of pay from Basirhat A.D.I they drew a resolution stating they had no objection if i applied for higher scale of pay. For almost 1 and a half year the concerned a.d.i has just neglected and ignored my prayer. This month the A.I. rejected my plea on the basis of G.O. dated 14.7.14. However, after closely perusing the G.O. i have noticed the last paragraph in the g.o. asking district administration to consider old cases. My question to you sir is that if i have the right to pursue my case further on the basis of the last paragraph and if i am eligible for higher scale of pay.
