REDRESSAL OF DISHONOURING AND HARASSMENT TO EX-SOLDIER-IN-SERVICE-TEACHER OF WEST BENGAL ONLY
SIR: I am an Ex-Sergeant S Banerjee(IAF), presently in-service primary teacher at West Bengal, posting this post for the behalf of thousands of Ex-Servicemen like me. An exceptional reluctance of over two years is UNFORTUNATELY experienced by me as well as number of Ex-Servicemen-in-Service Teacher. Departments like School Education Department(pry), Boards like WBBPE, Govt of West Bengal, Councils like D.P.S.Cs of respective Districts, Offices of District Inspectors of respective districts have never considered the issue any time. The time is coming to a crucial end. Representations from the Ex-Servicemen-in-Service Teachers, supported by the Policies, Orders, extracts of Govt. Service Manuals, extracts of verdict of Hon’le Supreme Court have been sent to your department for number of times. None of them have ever acknowledged or considered according to its merit. Leaving about the poor-Ex-Servicemen,. Last two years several copies of several orders are received by you without any action. Manuals and Memorandums of Min of Pers & Trg, Min of Def, Min of Education, Min of Home & Cabinet Sectt, Govt of India, have been provided to them for number of times by hand, by Reg’d Post. But, no good.
The Soldiers, join the Services Air Force,Army, Navy) after Matriculation. Passes many Exams of Physical, Mental, Strategical and Educational Tests, throughout their Prime age of Life and serves the Nation before self.
Such a soldier, who joined as a Matriculate, served minimum 15 years of Service, are granted Educational Certificate of Graduation, with equation to civil qualification, provided they acquire Technical or Professional qualification, where that experience is essential. This has been made the Order and Merit from all the Ministries and Cabinet Sectt., Govt of India. UPSC, SSC, Banking etc, everywhere an Ex-Servicemen is permitted to appear, even in the State Government Departments, Ex-Servicemen are there, where minimum qualification is Graduation. Some of the readers, must have the experience of their (EX-SM) standard of capability also. In this issue I wish to refer the Ex-SM employees of Govt Banks, LIC and a lot of Organisation.
Even an Air Warrior (IAF), used to join after Matriculation, and selected after a No. of Intensive competitive Tests, when passed the ‘CORPORAL EDUCATION TEST FOR PROMOTION TO THE RANK OF CORPORAL (Non-Commissioned Officer Rank) under Scheme-A (above 50%), are given away the Certificate of Higher Secondary, which is recognised, affiliated by all the Ministries, such as Min of Home, Min of Edn, Min of Pers & Trg and Cabinet Sectt, Govt of India and MOST IMPORTANT TO SAY THAT IT IS RECOGNISED, AFFILIATED AND ACCEPTED BY THE NCTE (THE ULTIMATE AND COMPETENT AUTHORITY TO ASCERTAIN THE EDUCATIONAL STANDARD OF THE TEACHERS OF ALL THE STATES OF INDIA. The WBBPE of West Bengal is only the state unaware with these, despite of providing all these authorities.
The Hon’le Supreme Court verdicts that “WHILE NOTICING INCONSISTENCY BETWEEN THE CENTRAL AND STATE STATUTES OR THE STATE AUTHORITIES ACTING CONTRARY TO THE CENTRAL STATUS, ..WHENEVER THE SITUATIONS/SEATS ARE AVAILABLE AND THE STATE AUTH DENY AN APPLICANT THE SAME ON THE GROUND THAT THE APPLICANT IS NOT QUALIFIED ACCORDING TO ITS STANDARDS OR QUALIFICATIONS, AS THE CASE MAY BE, ALTHOUGH THE APPLICANT SATISFIES THE STANDARDS OR QUALIFICATIONS LAID DOWN BY THE CENTRAL LAW, THEY ACT UNCONSTITUTIONALLY. SO ALSO WHEN THE STATE AUTH DE-RECOGNISE OR DISAFFILIATE AN INSTITUTION FOR NOT SATISFYING THE STANDARDS OR REQUIREMENT LAID DOWN BY THEM, ALTHOUGH IT SATISFIES THE NORMS AND REQUIREMENTS LAID DOWN BY THE CENTRAL AUTHORITY, THE STATE AUTH ACT ILLEGALLY” Judgement in the Supreme Court of India, by the Justice Swatanter Kumar, J against the Writ Petition of 276,395389, 397 of 2012. All the above are well accepted and materialised by all the State Govts and Central Govts Departments, as Ordered by the “NATIONAL EMPLOYMENT SERVICE MANUAL, VOL-II, PT-I, ANNEX-1(8), PAGE -99”, except the State of West Bengal.
Now, as per the Notification of NCTE, the most essential Professional Qualification of D.L.Ed, is completed by the all most all the teachers (Pry) of WB, including EX-SM-in-Service teachers. The Certificates and Mark sheets of D.l.Ed are given away to all the teachers except Ex-Servicemen Teachers, Applications for grant of Category ‘A” for all those teachers were processed, leaving the ex-servicemen teachers, even after passing the same their Certificates and Mark sheets are restrained unissued by all the DPSCs, even being unable to quote any reason or authority for non-issuance. Chairmen, DPSCs are not permitting Ex-SM teachers to meet with them. After all Ex-Sm teachers of various districts have forwarded their representations, addressing to PMO’s Office, NCTE,HQ, Min of HRD, Min of Def, Govt of India and with copy to SED(Pry)
Can any agency, Department, Govt would feel urge to intervene or suggest all these sufferers. But, One thing must be remembered, if at all justice is delayed but cannot be denied. -
